MINUTES <br />CITY COUNCIL <br />MAY 11, 2015 <br />another non -conforming extension to May 31st, as well as allow the <br />storage pod on the property to remain until that time. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-5-87 — APPROVING AN EXTENSION TO <br />APPLY FOR BUILDING PERMIT TO RE-ESTABLISH A NON- <br />CONFORMING USE AT 200-208 RYAN DRIVE AS REQUESTED BY <br />RUSS FISCHER AS WELL AS ALLOWING A STORAGE POD TO <br />REMAIN ON THIS PROPERTY TO MAY 31, 2015 AS <br />RECOMMENDED BY THE CITY ADMINISTRATOR. <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />QUIET ZONE The City Administrator reviewed his May 7, 2015 report relative to <br />AGREEMENTS Quiet Zone Agreements with MN DOT and the Soo Line Railroad dba <br />Canadian Pacific Railway for the establishment of quiet zones within <br />Little Canada. <br />The Administrator reported that the agreement with MN DOT addresses <br />the City's use of grant funds from the State's General Obligation Bonds. <br />These grant funds will pay for signals, crossing gates, upgraded circuitry, <br />lighting, and equipment house. The funds can be used to pay for roadway <br />improvements on City streets such as medians and signage. However, <br />they cannot be used for road improvements on County roads because the <br />County was not listed as an eligible recipient in the legislation. Shoreview <br />and Little Canada informed MN DOT to take the County road <br />improvements out of the funding program to avoid seeking revised <br />legislation. The Administrator noted that this is a non -issue given Little <br />Canada's costs exceed the bonding allocation. <br />The Administrator reported that the second agreement with the Soo Line <br />Railroad governs the construction of the signal and gate upgrades at the <br />City's six crossings. The City will be responsible for roadway <br />improvements at those crossings where medians will be installed. The <br />Administrator noted that at a recent on-site review with MN DOT and the <br />Federal Railroad Administration (FRA) officials, MN DOT made a <br />number of recommendations about median installation at a number of <br />crossings. These changes added over $100,000 to project costs and create <br />challenges regarding median impact on abutting properties. The <br />recommended median on County Road B negatively impacts the driveway <br />of a residential property, and on County Road B-2 the center turn -lane is <br />12 <br />
