MINUTES <br />CITY COUNCIL <br />MAY 27, 2015 <br />AMEND <br />ZONING <br />CODE — <br />SPECIAL <br />PURPOSE <br />FENCES <br />ADJACENT <br />TO RAILROAD <br />by their PUD Permit. The request is to allow another location in the <br />parking lot of Hardware Hank/Market Place Shopping Center once the <br />Hardware Hank garden center closes for the season. Therefore, the <br />farmers' market will operate likely the first two Monday's in June at the <br />Saxon site and the remaining Monday's at the Hardware Hank/Market <br />Place Shopping Center location. The Planner noted that there is a private <br />individual who has a PUD Permit for garden/vegetable sales at the Market <br />Place Shopping Center. This individual does not sell on Monday's so <br />there will be no conflict between the two markets. <br />Fischer reported that he has had a couple of conversations with individuals <br />about the farmers market, and it is felt that locating the farmers market at <br />the shopping center site will be a good move. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by Keis, the public hearing was <br />closed. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-5-98 — APPROVING AN AMENDMENT TO <br />THE PLANNED UNIT DEVELOPMENT (PUD) PERMIT FOR THE <br />OPERATION OFA SEASONAL FARMERS' MARKET AT THE <br />SAXON LANES AND THE MARKET PLACE SHOPPING CENTER <br />PROPERTIES SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN <br />HIS MAY 8, 2015 REPORT <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Keis opened the Public Hearing to review the Amendment to the Zoning <br />Code relating to special purpose fences adjacent to railroad rights-of-way. <br />It was noted that the Planning Commission recommended approval of this <br />amendment subject to compliance with the recommendations of the City <br />Planner as outlined in his May 7, 2015 report and subject to the condition <br />that a structural engineer is required to review and sign off on a fence plan <br />for a fence of this nature. <br />The City Planner reported that a citizen has requested that the Council <br />consider allowing taller fences for properties that abut railroad right -of - <br />3 <br />
