MINUTES CITY COUNCIL NOVEMBER 28, 2007 City Planner stated that this is not uncommon and it is beneficial to minimize the number of curb cuts onto LaBore Road. Montour asked about the front yard setback for the house that would be constructed on Lot 1. Benning replied that it would match as closely as possible with the front yard setbacks of the existing LaBore Road homes. There was no one present wishing to comment on this matter. Upon motion by Montour, seconded by Keis, the public hearing was closed. Mr. Montour inh•oduced the following resolution and moved its adoption: RESOLUTION NO. 2007-11-298 -APPROVING THE PRELIMINARY PLAT FOR WHISPERING PINES CONSISTING OF EIGHT (8) SINGLE-FAMILYHOMESAT 685 AND 693 LABORE ROAD SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER, CITY ENGINEER, PLANNING COMMISSION AND THE PARKS & RECREATION COMMISSION The foregoing resolution was duly seconded by McGraw. Ayes (4). Nays (0). Resolution declared adopted. TEXT Mayor Blesener opened the public hearing to consider applications for AMENDMENT a Text Amendment to the Zoning Code increasing the number of massage & PUD therapy businesses allowed in the General Business (B-3) and Planned PERMIT - Unit Development (PUD) Districts fi•om one to two as well as a PUD 27 LITTLE Permit for Massage 'Therapy Business at 27 Little Canada Road, Jill CANADA ROAll - Andert, Shawnee Soapmaker and Intuition Massage. Ms. Andert has MASSAGE also made application for a Massage Therapy Business License and THERAPY - Massage Therapist License. It was noted that the City Planner and the JILL ANDERT Planning Commission have recommended approval of the applications. The City Planner reported that the current ordinance allows one massage therapy business by Conditional Use Permit in the B-3 District. That one license has been issued to a business operating in the Edgewater Office Park. The Planner noted that staff is not aware of any problems with this business. The Planner noted that the applicant has made application for a Text Amendment to increase the number of licenses to two as well as include the PUD Zoning Districts. The Planner indicated that this type of business would fit in the location proposed noting that the entire north side of Little Canada Road is commercial uses.
