MINUTES CITY COUNCIL JUNE 27, 2007 3201 COUNTRY property. The City Planner and the Planning Commission have DRIVE - recommended approval subject to compliance with the recommendations HOM FURNITURE of the City Planner as outlined in his June 7, 2007 report with modification of the rezoning ordinance to require that the anchor tenant occupy a minimum of 40% of the building space and subject to Hom Furniture submitting an interim signage plan prior to tonight's meeting. The City Planner reviewed his June 7ln report relative to the PUD Rezoning, and noted that the proposed rezoning ordinance includes a list of retail uses that would be allowed under the PUD. These uses are typical of B-3 District uses, but are primarily lower volume retail uses. The Planner noted that the Planning Commission recommended that the proposed PUD District be modified to require that the anchor tenant would occupy at least 40% of the floor area of the building. This recommendation was made to ensure one primary tenant in addition to the smaller tenants. The Planner indicated that Hom Furniture has indicated that their financing people have expressed concerns with this requirement and its impact on long term financing for the property. The Planner then reviewed his June 22, 2007 report relative to additional information provided by Hom Furniture relative to signage. The Planner indicated that Hom is interested in two categories of signage. The first is for interim signage during their move-in and remodel phase of the project. Hom anticipates this phase will continue for a year, while the site is being remodeled. Interim signage and sign materials would be used. Once the remodeling is completed, permanent signage consisting of the proper materials would be installed. The second category of signage relates to temporary signage, and Hom is requesting to exceed the City's restrictions on temporary signage relative to number and size. The Planner noted that Hom is requesting the following: 1. Search Lights - 30 days cumulative for all tenants per year maximum. 2. Tents - 30 days cumulative for all tenants per year maximum. 3. Truck Load Sales - 30 days cumulative for all tenants per year maximum. 4. Seasonal Outdoor Displays -April 15`n to September 30`n 5. Temporary Signs - 108 square feet given building is set so far from the highway that 36 square feet can't be seen from most parts of the building.
