MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />Planner's Response to Additional Neighborhood Submittals; <br />Maplewood Interest in Cooperative Utility Project. <br />Dave Himmelbach asked that his letter be read aloud, which the Mayor <br />did. <br />The City Attorney noted the standards relative to undue hardship as cited <br />in the case of Nolan versus the City of Eden Prairie filed on May 23, 2000, <br />and indicated that this case controls those standards. The Attorney <br />recommended that at the conclusion of the Public Hearing, the Council <br />acting as the Board of Adjustment & Appeals make a determination on the <br />cul-de-sac Variance requested by Lauren Development. <br />There was no one else present wishing to comment on the Variance. <br />Upon motion by McGraw, seconded by Keis, the public hearing was <br />closed. <br />Blesener noted that the Planning Commission, City Planner, and the City <br />Attorney have indicated that hardship test to warrant the granting of this <br />variance has been met. <br />Montour noted that there has been a lot of discussion relative to this <br />Variance request. Montour felt that the City had to look toward the future <br />and plan for the development of this area. He noted that the developments <br />being presented to the City Council are getting harder and harder to review <br />given that there are just the more difficult areas of the City that are <br />undeveloped. Montour stated that he supported the Variance request. <br />McGraw felt that the Council had to do what is right for the City into <br />perpetuity. He also thanked Mr. Quam for his courtesy and respect that he <br />showed the City throughout this process. <br />Allan felt that the residents' concerns that have been presented to the <br />Council are heartfelt, and indicated that the Council shares many of these <br />concerns. She noted that the Council will be working to change some <br />aspects of the ordinance requiring larger lots, more tree preservation, etc. <br />in sensitive areas. However, these Codes have not been changed as of yet. <br />McGraw pointed out that this is a difficult decision for the Council, given <br />that the interests of all involved are so different. Some people are seeking <br />to protect their proper•cy, and others are seeking to develop their property. <br />McGraw indicated that he will vote in favor of the Variance. <br />Keis stated that he will also vote to support the Variance and he agreed <br />with the comments made by the other Council Members.
