MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />a. Consistent with Planning Commission recommendation, <br />the applicant provides a landscaping plan for ponding <br />area acceptable to the City. <br />b. Consistent with Planning Commission recommendation, <br />the applicant provides a tree preservation and <br />replacement plan acceptable to the City. <br />c. Consistent with Planning Commission recommendation, <br />the applicant complies with all final recommendations <br />of the City Engineer. <br />d. Consistent with Planning Commission recommendation, <br />a final resolution for joint utility services for the area is <br />reached with the City of Maplewood. <br />6. The plat's proposed street, at a length of approximately 1,050 <br />feet, is eligible for a variance to the Subdivision Ordinance <br />maximum of 500 feet, based on findings as follows: <br />a. The Subdivision Ordinance requires that subdividers <br />extend streets within a proposed plat to neighboring <br />property to provide opportunity for future <br />development, per Subdivision Ordinance Section <br />1006.030 (a). This results in an undue hardship <br />pursuant to Subdivision Ordinance Section 1010.010 <br />(a). <br />b. There are no other options for access to this property <br />that would provide the opportunity for full development <br />of the subject property, nor to adjoining property that <br />would be consistent with the Subdivision Ordinance as <br />required by Subdivision Ordinance Section 1006.030 <br />(a). This results in an undue hardship pursuant to <br />Subdivision Ordinance Section 1010.010 (a). <br />c. Undue hardship is present in putting the property to a <br />reasonable use if strict compliance with the 500 foot cul- <br />de-sac regulation is required, per Subdivision <br />Ordinance Section 1010.010 (c). <br />d. Without the variance, the applicant will not be able to <br />put his property to reasonable use since much of the <br />area will be inaccessible, per Section 1060.030 (c). This <br />results in an undue hardship pursuant to Subdivision <br />Ordinance Sections 1010.010 (a) and (c). <br />e. The proposed cul-de-sac is temporary in nature, with <br />the possibility that the street would be extended into <br />adjoining property in the future, per Subdivision <br />Ordinance Section 1060.030 (b) and (d). This finding is <br />consistent with Subdivision Ordinance Section 1010.010 <br />(b). <br />21 <br />
