MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />£ When the stub-street is extended to Beam Avenue to the <br />east, the cul-de-sac will no longer exceed the 500 foot <br />regulation in accordance with Subdivision Ordinance <br />Section 1006.030 (b). This finding is consistent with <br />Subdivision Ordinance Section 1010.010 (b). <br />The development of the proposed plat will provide an <br />opportunity to extend both public sanitary sewer and water <br />systems to other properties in the area which do not have <br />access to full services, consistent with City policy, and <br />Subdivision Ordinance Section 1008. This finding is consistent <br />with Subdivision Ordinance Section 1010.010 (b). <br />8. Per City Comprehensive Plan policy, the lack of current public <br />sanitary sewer and water in the area constitutes a hazard to <br />environmental conditions and public safety. This finding is <br />consistent with Subdivision Ordinance Section 1010.010 (b). <br />9. The plat provides future access to other portions of the <br />neighboring properties which would otherwise be landlocked <br />and unusable as required by Subdivision Ordinance Section <br />1006.030 (a). This finding is consistent with Subdivision <br />Ordinance Section Sections 1010.010 (a) and (c). <br />10. The proposed plat improves stormwater runoff, water quality, <br />and flooding conditions in the area through the use of <br />detention and infiltration ponding to divert and control <br />stormwater which is currently a threat to adjoining property, <br />consistent with Subdivision Ordinance Section 1006.050. This <br />finding is consistent with Subdivision Ordinance Section <br />Sections 1010.010 (b). <br />11. The conditions cited herein constitute special and unique <br />circumstances with would deprive the applicant of the <br />reasonable use of his land, consistent with the requirements of <br />Subdivision Ordinance Section 1010.010 (a). <br />12. The granting of the variance will not only not be detrimental to <br />public health, welfare, and nearby properties, but will improve <br />conditions of stormwater, flooding, and utility services, <br />consistent with Subdivision Ordinance Section 1.010.010 (b). <br />13. The variance is intended to correct inequities resulting from <br />extreme hardship, including topography and soils which limit <br />location of potential connecting roads, and other physical <br />22 <br />
