MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />factors including shape of the property as required by <br />Subdivision Ordinance Section 1010.010 (c). <br />14. The applicant has complied with the City's requests for <br />information and met the requirements for Preliminary Plat <br />and variance applications as required by Subdivision <br />Ordinance Section 1010.020. <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-]0-277 -ADJOURNING AS THE BOARD <br />OFADJUSTMENT & APPEALSAND RECONVENING AS THE <br />CITY COUNCIL <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Mayor Blesener brought back to the table consideration of the application <br />for Preliminary Plat for Richie Plane consisting of 16 single-family lots, <br />13 of which are located in Little Canada. Blesener noted that the City <br />Planner and the Planning Commission recommended approval of the <br />Preliminary Plat. He noted that at the City Council's September 26"' <br />meeting a motion to approve the Preliminary Plat failed. A subsequent <br />motion recommended reconsideration of the Preliminary Plat at a future <br />Council meeting. Blesener noted that the public hearing on the <br />Preliminary Plat was closed on September 26"'. However, the Council <br />would consider additional comments this evening. <br />Dave Himmelbach asked if side yard setbacks greater than 7 '/z feet could <br />be required by the Board of Adjustments & Appeal. Blesener noted that <br />the Board only considered the Variance request. With regard to previous <br />comments about the dumping done by Mr. Richie, Himmelbach indicated <br />that he was not exactly sure where the property line was until this spring <br />when the sm•vey was done. <br />Jolene Gores questioned whether the proposed pond was in the best <br />location. Blesener noted that all engineering requirements will have to be <br />complied with as part of the final plat. Kip Johnson, engineer for the <br />developer, indicated that the pond will work in the location that is <br />proposed. Blesener asked about the ravine that is currently lower than the <br />23 <br />
