MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />existing lot or parcel of record, narrowness, <br />shallowness, insufficient area or shape of the property. <br />(2) Special conditions and circumstances may not be <br />primarily economic in nature. <br />b. Literal interpretation of the provisions of this Ordinance <br />would deprive the applicant of rights commonly enjoyed by <br />other properties in the same district under the terms of this <br />Ordinance. <br />c. The special conditions and circumstances do not result from <br />the actions of the applicant. <br />d. Granting the variance requested will not confer on the <br />applicant any special privilege that is denied by this Ordinance <br />to other lands, structures, or buildings in the same district. <br />e. A genuine hardship exists in complying with the literal terms <br />of this Ordinance. <br />3. The applicant's existing outdoor storage area is consistent with <br />previously granted Conditional Use Permit requirements with <br />regard to area. <br />4. The relocation of the outdoor storage area to another location <br />on the property will facilitate a building addition to the <br />principal building rather than a detached accessory building, <br />consistent with preferred City policy. <br />5. Without the existing outdoor storage area, a hardship is <br />present in putting the property to a reasonable use for <br />landscape maintenance and tree removal due to the size of <br />equipment. <br />6. The relocation of the outdoor storage area provides a superior <br />screening effect by placing it behind the existing and proposed <br />building. <br />7. The requirements of Zoning Ordinance Section 922.020 as <br />cited above are met. <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Blesener noted that the City Planner and Planning Commission have <br />recommended denial of the Variances for accessory building size and <br />building materials. <br />
