MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2007 <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2007-10-274 -APPROVING THE <br />CONDITIONAL USE PERMIT ALLOWING RETAIL VEHICLE <br />SALES (INDOOR ONLY) AT 209 RYAN DRIVE AS REQUESTED BY <br />ROGER STANKE SUBJECT TO THE LICENSE BEING LIMITED <br />TO A MAXIMUM OF EIGHT VEHICLES <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PRELIMINARY The City Attorney reported that at its September 26, 2007 meeting <br />PLAT & the City Council continued action on the proposed the Richie Place <br />VARIANCE - Preliminary Plat until this evening's meeting. The Attorney also noted <br />RICHIE since the September 26°' meeting, Lauren Development applied for a <br />PLACE Variance for cul-de-sac length. That variance request has been reviewed <br />by the Planning Commission. The City Attorney noted that the Richie <br />Place Preliminary Plat is now before the City Council for consideration, <br />and the Variance request should be considered by the Board of <br />Adjustments & Appeals. <br />The City Attorney indicated that in considering the Variance request, the <br />Board of Adjustments & Appeals must consider Section 1010.010 of the <br />Subdivision Code, which is laid out in the City Planner's report dated <br />October 5, 2007. This sections requires that a hardship exists in order to <br />warrant the granting of a variance. Any action granting a variance should <br />be supported by specific findings. <br />Mayor Blesener recommended that the Council convene as the Board of <br />Adjustments & Appeals in order to consider Lauren Development's <br />variance request. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2007-10-275 - RECESSING AS THE CITY <br />COUNCIL AND CONVENING AS THE BOARD OFADJUSTMENTS <br />& APPEALS IN ORDER TO CONSIDER THE LAUREN <br />DEVELOPMENT VARIANCE REQUEST <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0).
