MINUTES <br />PLANNING COMMISSION <br />MARCH 8, 2007 <br />replied that he understands that they can have no vehicles stored outside for <br />either sales or repairs. He indicated that they are able to have for sale <br />vehicles outside at their Ham Lake site. Eddy reported that their request is <br />to Amend the CUP to allow indoor auto repair at 200 Ryan Drive in <br />conjunction with their indoor retail auto sales license. <br />Mr. Duray recommended approval of an Amendment to Conditional Use <br />Permit to allow motor vehicle repair in conjunction with the Auto Sales <br />(Indoor) License for Voyageur Motors at 200 Ryan Drive subject to their <br />being no outdoor storage or display of vehicles for sale or for repair at the <br />site or any outdoor storage whatsoever, and subject to their being no vehicle <br />painting at the site. <br />Motion seconded by Socha. <br />Motion carried 5 - 0. <br />PROPERTY Mr. Jack Belin appeared before the Commission requesting approval of a <br />DIVISION - property division of the parcel and townhome at 69 and 75 Demont Avenue <br />69 AND 75 into two single-family lots. Belin felt that the property division would <br />DEMONT encourage individual home ownership rather than rental property. <br />AVENUE - <br />BELIN Knudsen asked about a condominium arrangement, rather than dividing the <br />property into two separate parcels. Belin reported that from a financing <br />standpoint, interest rates charged for condominiums are more expensive <br />those for townhouses. <br />Knudsen asked if there was cone-hour firewall between the two units. <br />Belin was not sure. He noted that the house was a modular home that <br />consisted of four pieces which were placed on the foundation. Belin stated <br />that he has reviewed the house plans that the City has on file. These plans <br />are very generic in nature. Belin stated that it will be difficult to determine <br />whether or not there is a one hour wall separating the units without <br />disrupting that wall. Knudsen noted that the wall has to extend up through <br />the roof. Belin stated that he has been in the attic and there is a sheetrock <br />wall up to the roofline. Kevin Vickers, owner of the property, indicated that <br />they have tried to contact the builder to determine if he has more extensive <br />plans showing a fire wall, but has not received a response. Knudsen pointed <br />out that if a whole has to be cut into the wall to determine whether or not it <br />is a one-hour fire wall, then that is what will have to be done. Belin stated <br />that his concern was damage to the wall. He pointed out that regardless of <br />whether the structure is a duplex or a townhome, there will be two families <br />living in the house. Belin asked how he would be able to prove that the <br />fire wall already exists. <br />-3- <br />
