MINUTES <br />CITY COUNCIL <br />MARCH 26, 2008 <br />PERMIT that Dave Holm, On-Site Sanitation, indicated that he did not receive a <br />notice of the Public Hearing, therefore, has requested the opportunity to <br />appear before the Council and request a reconsideration. <br />The City Clerk indicated that the Public Hearing Notice was mailed to Mr. <br />Holm, On-Site Sanitation, and was published in the City's legal newspaper <br />as well. <br />The City Administrator reviewed the Council's February 27, 2008 action <br />to not renew the disposal permit, reading the findings of fact supporting <br />that action. <br />Dave Holm, On-Site Sanitation, appeared before the Council. He <br />indicated that he did not receive the hearing notice. He did receive a copy <br />of the Public Works Superintendent's February 6`~' report to the City <br />Council which recommended that the topic be on the February 27, 2008 <br />Council agenda. He considered that a recommendation only and not <br />indication that the matter would be discussed on February 27tH <br />Holm reported that On-Site Sanitation has been dumping into the City's <br />sanitary sewer system for the past 15 years. Holm reported that there has <br />been only one incident in 2004 when an On-Site drainage hose was found <br />in the sewer line and was retrieved by the City's Public Works <br />Department. Based on that incident, the Public Works Supervisor <br />redesigned the dump station and required On-Site to make the <br />modifications. Holm reported that this redesign has increased odors and <br />has reduced flow through the system. Holm also reported that the <br />redesign modifications cost him thousands of dollars to make. <br />Holm reported that in 2005 there was a sewer back-up into the Kath <br />Building and his and the City's insurance companies have gone after one <br />another relative to the claim. Holm reported that the back up was due to <br />nails and bolts in the sewer line, and he reported that the On-Site trucks <br />cannot pump those items, therefore, did not discharge them into the line. <br />Holm reported that his neighbors were not aware that he has been <br />dumping into the City's sewer line for the past 15 years. It was only after <br />the modifications that he was required to make that increased odors that <br />the neighbors became aware of the dump site. Holm again pointed out <br />that the modifications were mandated to him by the Public Works <br />Supervisor. Again, these mandates increased odors and decreased flows. <br />The decreased flows allow for more settlement in the bottom of the sewer <br />line. <br />Holm expressed concern with statements made by the Public Works <br />Superintendent in his February 6, 2008 report, feeling that the <br />10 <br />
