MINUTES
CITY COUNCIL
MARCH 26, 2008
Blesener noted that there are other very recent plats impacted by the
application of this portion of the Subdivision Ordinance in addition to
Richie Place. These are Whispering Pines, Canadian Woods, and Gervais
Hills. Blesener noted that the City needs flexibility in applying its
Subdivision Ordinance given the land that is left to develop. Blesener
stated that a strict interpretation of the Code would result in developments
that did not make the best use of the property. By clarifying the
Subdivision Ordinance, the City will end up with nicer lots and will save
more trees.
The City Attorney noted that the proposed amendments to the Subdivision
Ordinance reflect the actual intent and practice of the City. He noted that
the clarification of the wording of the ordinance will preserve natural
resources and provide for better erosion controls in balance with not
jeopardizing public safety.
McGraw agreed that the clarifications reflect the City's past interpretation
of the Subdivision Code. He noted that based on these clarifications the
City will have some flexibility in considering plat applications going
forward.
There was no one present from the general public wishing to comment on
this matter.
Upon motion by Keis, seconded by McGraw, the public hearing was
closed.
Mr. Keis introduced the following resolution and moved its adoption:
RESOL UTION NO. 2008-3-82 - ADOPING AN ORDINANCE
AMENDING CHAPTER 1006.030 OF THE LITTLE CANADA CITY
CODE, KNOWNAS THE SUBDIVISION ORDINANCE, BY
PROVIDING FOR AMENDED REGULATIONS RELATING TO
DEAD-END AND CUL-DE-SAC STREETS
The foregoing resolution was duly seconded by Blesener.
Ayes (3).
Nays (0). Resolution declared adopted.
ON-SITE Mayor Blesener noted that on February 27, 2008 the Council held a
SANITATION- Public Hearing to consider action on the renewal of the Disposal Site
DISPOSAL Permit for On-Site Sanitation which expires on May 31, 2008. At that
SITE hearing the Council decided to not renew the permit. Blesener noted
