MINUTES <br />CITY COUNCIL <br />May 14, 2008 <br />Walstead asked how the Engineer would evaluate the Hidden Acres pond <br />to determine whether it had capacity to take run-off from the south section <br />of Condit. The Engineer stated that he will have to evaluate the drainage <br />as well as verify the capacity of the pond as part of the work that will be <br />done to prepare project plans and specifications. The City Administrator <br />noted that there is a storm sewer pipe on Nadeau Road. The Engineer will <br />have to determine if that pipe has the capacity to take run-off from the <br />south end of Condit Street as well as will have to evaluate the pone. The <br />Administrator noted that it may not be a viable option, but merits <br />consideration. <br />Walstead indicated that there is sand washing from under the sod into the <br />pond at the new house adjacent to the pond. She also indicated that there <br />are settlement holes in her yard. The Administrator indicated that the City <br />would look at this fi•om a stabilization standpoint. <br />Steve Poindexter, The House, pointed out the proposal to assess his <br />property at the full commercial rate pointing out that they have no access <br />to Condit Sheet. Keis pointed out that The House property abuts Condit <br />Street and it is zoned commercial. Poindexter stated that they would be <br />agreeable to an access restriction to Condit Street for some consideration <br />in the assessment amount. <br />The City Administrator noted that the City Engineer utilized the City's <br />Assessment Policy in determining the assessment roll. The Administrator <br />agreed that there were some unique factors in play, and pointed out that <br />the City has to meet the benefits received test in assessing properties. The <br />Administrator suggested that staff look at the assessment issue for these <br />commercial properties considering the equity issue and come back with a <br />recommendation to the Council. <br />Allan agreed that the equity issue should be studied given the lack of <br />access my most of the commercial properties. The Administrator pointed <br />out the study would have to consider whether or not any precedent would <br />be set that would impact other commercial properties for future projects. <br />Allan asked about the Kandice II property and Biagini properties. The <br />City Administrator noted that those projects were denied access given that <br />they backed up to the Condit Sheet residential area. It was noted that <br />these properties are also proposed to be assessed at the commercial rate. <br />The City Engineer noted that he applied the City's Assessment Policy in <br />putting together the proposed assessment roles. That Policy does not <br />provide any relief in the assessment formula based on the issue of access. <br />The Adminishator felt that the issue merited study.
