MINUTES <br />CITY COUNCIL <br />May 14, 2008 <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Allan, seconded by Montour, the public hearing was <br />closed. <br />Montour stated that he was concerned with the level of assessments for the <br />commercial property. He stated that he supports curb and gutter and <br />would like to see a 24-foot urban section road provided that something can <br />be worked out with the commercial property owners. Blesener noted that <br />City staff will study the issue of benefits received and determine the level <br />of assessment to the commercial property that can be supported. <br />Keis agreed that the assessment level should be looked at, but indicated <br />that to not put in an urban section road would be the wrong thing to do. <br />He noted that this would open the issue to every other neighborhood <br />where a road reconstruction is contemplated. The City's standards have <br />been for concrete curb and gutter. <br />The City Administrator indicated that he would have an appraiser look at <br />the improvement and determine the level of assessment that can be <br />supported. He noted that obtaining an appraisal was a standard practice <br />until the City implemented its assessment cap which resulted in <br />assessments not being challenged. The Administrator acknowledged that <br />this was a unique situation that merits further consideration. Given that <br />this project would be constructed late summer, the Administrator <br />suggested that the Council could wait to order the improvement for up to a <br />month if it preferred. <br />The City Engineer asked that if ordering the improvement is delayed, that <br />the Council at a minimum authorize the soil borings so that he can <br />determine the level of street section that would be required. <br />Blesener pointed out that any change in assessment level does not impact <br />the other properties being assessed, it only impacts the City's cost. <br />Blesener stated that he supported the urban section street. Allan noted that <br />most of the Condit Street property owners prefer curb and gutter. <br />Blesener noted that the only big issue to be resolved is the commercial <br />assessment rate. <br />Montour noted that the Council must be the stewards of the City's <br />infrastructure, and felt that an urban section design was preferable. He <br />indicated that his only concern is whether the commercial assessment <br />proposed would meet the benefits received test. <br />6 <br />
