(j) All applicable Rice Creek Watershed District requirements are <br />satisfactorily met. <br />RCWD shall provide a letter waiving any permit requirements other than having the site <br />included on MN/DOT SWPPP for SP 6281-47. <br />(k) So as to maintain compatibility with the surrounding area and to protect <br />the health, safety and general welfare of the public, the City Council may impose <br />additional limitations, conditions or requirements as it deems necessary. <br />Additional conditions will be detailed in the Council Resolution the interim use permit is <br />approved. <br />(1) The operator and property owner shall enter into a Performance <br />Agreement with the City, and financial sureties shall be posted prior to any site <br />disturbance. <br />A Performance Agreement shall be drafted by the City and entered into by the applicant prior to <br />setup and operation of the temporary batch plant. <br />RECOMMENDATION <br />Staff recommends denial of the Interim Use Permit for a Batch Plant for Arnt Construction (2209 <br />Phelps Road) due to the following outstanding issues: <br />1. Items listed in City Engineer letter dated May 4, 2016. <br />2. Grading, erosion and sediment control plans have not been submitted to the City. <br />3. A SWPPP has not been submitted to the City. <br />4. Property owner consent letter from Paul Miller has not been submitted to the City. <br />5. A letter from RCWD has not been submitted to the City. <br />6. Staff has concerns regarding the proposed internal haul routes on Phelps Road. <br />7. Existing deteriorated road conditions of Phelps Road. <br />If these outstanding issues are resolved, the interim use permit may be approved with the <br />following conditions: <br />1. The applicant shall sign a Site Performance Agreement and deposit financial sureties with <br />the City prior to set up and operation of the temporary batch plant. <br />2. The temporary batch plant shall begin set up on June 6, 2016 and shall be completely <br />removed by June 30, 2016. <br />3. Hours of operation shall be consistent with Section 901.03(4)(b): <br />7:00 a.m. to 7:00 p.m. <br />Monday through Friday <br />9:00 a.m. to 5:00 p.m. <br />Saturday <br />No construction activity allowed <br />Sunday and federal holidays <br />I <br />
