COUNCIL MEETING JANUARY 9, 1995 <br />presented by Mr. Hawkins. Council Member Neal seconded the <br />motion. Motion carried unanimously. <br />Update Regarding Adams Outdoor Advertising Litigation - Mr. <br />Hawkins explained that several years ago the City Council had <br />denied a Conditional Use Permit for Adams Outdoor Advertising to <br />construct two (2) billboards along I35W and I35E. A summons has <br />now been received by the City. Adams Outdoor Advertising is <br />claiming that the reasons for denial were not appropriate. The <br />matter has been turned over to the League Trust Insurance and <br />they has accepted the defense of the City and have assigned Mr. <br />Thomas N. Scott to the represent the City. Mr. Hawkins will act <br />as liaison and keep the City Council updated on this matter. <br />Update Regarding A & L Superior Quality Sod, Inc. - Mr. Hawkins <br />explained that a suit has been filed alleging damage to the <br />Robinson sod farms due to a culvert that was plugged during the <br />construction of Apollo Drive. Arcon Construction was the <br />contractor on this project and has agreed to assume <br />responsibility under the terms of the construction contract. <br />This matter will be monitored by Mr. Hawkins and an attorney for <br />the League Trust Insurance. Mr. Hawkins will keep the City <br />Council updated on this matter. <br />CONSIDERATION OF THE SECOND READING OF ORDINANCE NO. 18 - 94 <br />AMENDING THE CITY CODE BY ELIMINATING THE REQUIREMENT FOR <br />INDIVIDUAL SURETY BONDS AND PURCHASING A BLANKET PUBLIC EMPLOYEE <br />DISHONESTY BOND, RANDY SCHUMACHER <br />Mr. Schumacher explained that the FIRST READING of this ordinance <br />was held December 19, 1994. No comments or suggested changes <br />have been received since that time. <br />Currently the City code requires that the City Assessor, Clerk - <br />Treasurer, Administrator, Deputy Clerk -Treasurer and Building <br />Inspector be bonded separately. In 1984, the State Statutes were <br />amended to allow a blanket dishonesty bond to cover all <br />employees. By amending the City Code as proposed, the City <br />Council will establish the requirement for a blanket bond and be <br />able to change the specific dollar amount of the blanket bond by <br />adopting a resolution each time the dollar amount must be <br />changed. <br />Mr. Schumacher noted that the cost of dishonesty bonds will <br />increase by $12.00, however, the blanket bond will cover all <br />employees and the City Council. <br />Council Member Kuether moved to adopt Ordinance No. 18 - 94 as <br />PAGE 4 <br />
