However, the City <br />Council cannot guarantee there will be four (4) buildable lots. <br />Mr. Birch has approximately six (6) months to go through the <br />process before the court takes further action. <br />Council Member Bergeson said he felt it is fair to let Mr. Birch <br />know that wetland delineation is an important part of the <br />process. <br />Mr. Schumacher said he met with Amy Donlin and talked to her <br />about mediation of the matter with the neighborhood. Mayor <br />Reinert explained that the neighborhood has to be informed that <br />the City Council cannot oppose Mr. Birch if he meets all of the <br />ordinance requirements including wetland delineation. Mr. <br />Hawkins explained that the City has to let Mr. Birch know that he <br />will have no opposition as long as all of the City ordinances are <br />met. <br />Mr. Radio will let the City Council know what Mr. Birch's <br />response is via Mr. Schumacher. <br />Mr. Radio will let the City Council know the time, place and date <br />for the arguments in the appeal process. He noted that this will <br />be more impressive than in the lower court.
