APR -07-1995 11:24 <br />NAC 612 595 9837 P.05 <br />Comprehensive Plan. The City's Land Use Phan suggests single family residential use of the <br />subject property. While the proposed use is considered consistent with the Comprehensive Plan, <br />the proposed net density (2.8 units per acre) cannot be accommodated without the subject <br />property being incorporated within the MUSA. <br />To accommodate the proposed first phase of development (45 lots), the applicant is proposing <br />a MUSA land trade. Specifically, the applicant wishes to apply 27 acres of MUSA currently <br />superimposed upon a tract of land located south of Birch Street and east of Shadow Lake Drive <br />(see Exhibit C). In regard to the proposed MUSA trade, the following should be noted: <br />1. The llehrns Century Farm site is included within a proposed comprehensive, City-wide <br />expansion of the MUSA. Such amendment will require Metropolitan Council approval. <br />2. The proposed MUSA land trade is consistent with the City's growth objectives (proposed <br />MUSA expansion). <br />3. The MUSA land trade will most effectively accommodate the applicant's immediate <br />development objectives. Such trade will, however, require approval by the Metropolitan <br />Council. <br />Any approval of proposed subdivision will be contingent upon Cityand Metropolitan Council <br />approval of the amendment to the City's Comprehensive Plan. It should be recognized, <br />however, that approval of the preliminary plat in no case guarantees approval of the site's fixture <br />phases being included in the City's MUSA. Rather, future phases will be considered for <br />inclusion in the MUSA only at the time of final plat. <br />In 1992, the City Council passed a resolution which established policy for the location of new <br />development. The policy basically states that a new development shall be allowed to proceed <br />only if the developer can demonstrate: <br />a_ That the cost of utility and street extensions can be covered by immediate assessment. <br />b. <br />c. <br />That the cost of operation and maintenance of the system will not exceed normal costs <br />as projected by the water and sewer rate study. <br />That an up front payment or series of payments by the developer would offset any <br />additional costs of installation and/or future operation and maintenance. <br />The proposed development complies with the provisions of the aforementioned resolution. <br />4 <br />
