Planning & Zoning Board <br />June 14, 2017 <br />Page 5 <br />APPROVED MINUTES <br />Mr. Stoesz asked if Lot 1 would be able to put a fence on the left hand side. Ms. Larsen <br />confirmed that they would be able to and that there is no separation requirement between <br />a fence and a house. <br /> <br />Tim Anderson (applicant), 547 Lois Lane, confirmed the distance shows 17 feet on the <br />east side of the property. Mr. Laden expressed concerns with the setback. Mr. Anderson <br />said the intent is to have the driveway on the east side to save as many trees as possible <br />and to look aesthetically better. Mr. Laden stated that it is going to put your living space <br />closer to the garage than what the city normally allows. Mr. Anderson stated that they <br />will place the pad as far as possible from the lot line. Mr. Laden asked if the city would <br />want to consider a greater setback, be it a house or garage on lot 2. Mr. Anderson stated <br />that all garages are set on the east so they would not be a concern. Ms. Larsen stated that <br />staff has no concerns with setbacks or garage placement. Ms. Larsen questioned if the <br />Board was suggesting a mandatory 10 foot setback regardless of a house or garage. Mr. <br />Laden stated if it’s a garage, it would only have to be 5 feet. Mr. Stimpson supported Mr. <br />Laden’s point by saying all homes in Haley Manor have adjacent driveways, this <br />development would be opposite of that. Mr. Anderson stated his driveway is on the east <br />side, as well as the others. Mr. Root clarified that 565, 571, 583 all have different garages <br />to support Mr. Laden’s point. Mr. Laden thought that would be more desirable and to <br />maximize the space between the two since we are coming up short. Mr. Anderson stated <br />his intent is to direct the home builder to construct the garage on the east side. Mr. Laden <br />suggested the house be on the east side for greater separation. Ms. Larsen stated we could <br />require 10 feet on lot 2 regardless of if it’s a garage or house. Chair Tralle stated that the <br />person who builds the house can decide if it is on the right or left. <br /> <br />Chair Tralle declared the Public Hearing open at 7:21 p.m. <br /> <br />There was no one present to speak. <br /> <br />Mr. Masonick made a MOTION to close the Public Hearing at 7:22 p.m. Motion was <br />supported by Mr. Stoesz. Motion carried 6 - 0. <br /> <br />Mr. Evenson made a MOTION to recommend approval of Golden Acre. <br /> <br />Motion was supported by Mr. Stoesz. Motion carried 6 - 0. <br /> <br />D. Chavez Preserve Variances and Final Plat <br /> <br />Ms. Larsen presented the staff report. <br /> <br />The applicant, Marcel Eibensteiner with Royal Oaks Realty, Inc., submitted a land use <br />application for two (2) variances and final plat for Chavez Preserve. The proposed <br />development is a 6 lot single family residential subdivision. It contains 1 existing parcel <br />(177 White Pine Road) that is approximately 2.18 gross acres. The variances are for <br />reduced right-of-way and reduced front setbacks. <br />
