In regard to the Planned Development Overlay/site plan review, staff found <br />that the proposed site design attempts to maximize the development <br />potential of the site through the use of private street which required a <br />variance and housing design that fails to comply with the R-4 green space <br />requirements, exclusive of the dedicated park land. The result is a site that <br />is aver -utilized, presenting concerns for traffic circulation, open space, and <br />Ing. <br />Above the City regulations, staff was informed by the DNR that upon <br />notification that the City must update its shoreland regulations, any <br />development that is defined as a PDO under the new State Shoreland <br />Statutes, must be reviewed by the DNR and comply with the State density <br />and design standards. <br />Based on staff's review, the proposed site plan did not comply with all City <br />performance standards and did not meet the State shoreland standards. <br />Under these conditions, staff could not recommend approval of the PDO <br />or site plan. <br />The City was updating its Shoreland Ordinance in compliance with State <br />Statutes. As part of this update, the City is requesting flexibility from a <br />number of State shoreland performance standards specifically related to <br />development density and multiple family development. To avoid the strict <br />enforcement of the current State standards, staff advised the applicant to <br />pursue site development after the City finalizes its Shoreland Ordinance <br />update. <br />10/12/94 Applicant requests postponetuent of City consideration to a future, unspecified <br />date. <br />4/17/95 Prior to finalization of Lino Lakes Shoreland Ordinance, applicant requests site <br />plan review of a revised development concept. The revised site plan calls for the <br />development of 112 condominium/townbome units upon a 25.5 acre site (see <br />Exhibit B). The site plan complies with the State shoreland regulations and is <br />approved by DNR. <br />3 <br />
