75518 <br />WHEREAS, so that the jurisdictional transfer can take place, the turn <br />back agreement should provide for the accomplishment of the relevant <br />objectives specified in the Memo of Understanding and as hereinafter <br />set forth; and <br />WHEREAS Minnesota Statutes Section 161.20, subdivision 2 (1996) <br />authorizes the Commissioner of Transportation to make arrangements <br />with and cooperate with any governmental authority for the purpose of <br />constructing, maintaining and improving the trunk highway system. <br />IT IS, THEREFORE, MUTUALLY AGREED AS FOLLOWS: <br />ARTICLE I - ROADWAY TO BE TURNED BACK <br />The State shall transfer to the City jurisdiction of the 4th Avenue <br />North section of Trunk Highway No. 49 between Lilac Street and the <br />main entrance to the Lino Lakes Correctional Facility, a distance of <br />0.28 miles, under State Project No. 0204-14 (T.H. 49=326). <br />ARTICLE II - INFORMATION AND RECORDS PROVIDED BY THE STATE <br />Upon execution and approval of this agreement the State shall, upon <br />request, provide the City with the following information and• records <br />that are applicable to the portion of Trunk Highway No. 49 described <br />in Article I hereof, to the extent that they are available: <br />A. A list of active maintenance agreements with other governmental <br />agencies and utility companies that will be canceled. <br />B. Utility, drainage, access driveway, sign advertising and limited <br />use permits. <br />C. As built construction plans and microfilm records. <br />3 <br />
