Public Hearing, Resolution No. 12-68,Approving a Conditional Use Permit <br /> 143 to allow grading and earth removal <br /> 144 <br /> 145 City Planner Bengtson reviewed the request for a conditional use permit to allow the removal of an <br /> 146 earthen berm from the site to allow future expansion. He reviewed the location and the plans for <br /> 147 work using a map projection. He reviewed how dirt would be removed from the city and noted that <br /> 148 there would be approximately 2,000 trips. Staff finds that the application and the conditions attached <br /> 149 will allow the applicant to meet requirements. There is a recommendation to add a thirteenth <br /> 150 condition relating to the posting of"trucks hauling" signs, as a safety precaution. <br /> 151 <br /> 152 Mayor Reinert opened the public hearing. <br /> 153 <br /> 154 Michael Root, 1066 Cripple Creek Pass, noted the thirteenth condition added by the Planning and <br /> 155 Zoning Board. He also asked that drivers be informed that the roadway is very narrow and is traveled <br /> 156 quite heavily not only by cars but also bikers and walkers. He also noted the 7:00 a.m. starting time <br /> '57 and that the intent isn't to actually be on the roadways at that time because traffic is quite heavy then. <br /> '-158 <br /> 159 Mr. John Palmer, representing the developer, responded. The Planning & Zoning Board did discuss <br /> 160 the hours of operation and he offered full cooperation in not hauling until 8:30 a.m. and not during the <br /> 161 heaviest traffic time in the afternoon (to be identified). He added that they (applicant) have already <br /> 162 added an extensive length of gravel to their driveway to keep any mud problems to a minimum. <br /> 163 <br /> 164 Chris Lyden, 6275 Holly Drive West, two doors north of the applicant. He is comfortable with the <br /> 165 work proposed. The company is a good neighbor and has done a good job explaining all the proposed <br /> 166 work and precautions to the residents. <br /> 167 <br /> 168 There being no one else wishing to speak, the public hearing was closed at 7:07 p.m. <br /> 169 <br /> 170 Council Member Roeser moved to approve Resolution No. 12-68 with the addition of Condition#13. <br /> 171 Council Member Rafferty seconded the motion. Resolution No. 12-69, Authorizing execution of a site performance agreement with <br /> 174 Encompass Digital Media <br /> 175 City Planner Bengtson explained that the resolution authorizes execution of a performance agreement <br /> 176 that will guarantee the financial securities and road fees as well as necessary project inspections. <br /> 177 <br /> 178 Council Member O'Donnell moved to approve Resolution 12-69 as presented. Council Member <br /> 79 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br /> 4 <br />
