Page -3- <br />November 15, 1978 <br />Mr. Hill asked if there will be a problem with the new building being located so far off <br />the street. Mr. Gourley said there would be no problem with the ordinance in this area. <br />Mr. Gourley explained the purpose of the Special Use Permit and said if Mr. Klenck has it <br />prepared properly and to the Clerk 10 days prior to the December 20, 1978 Board meeting <br />this Board will consider it then. <br />Roy Stanley - Variance <br />Mr. Stanley had presented two xariances to split two lots in Sunset Oaks. Mr. Hill cal- <br />culated each new lot would be one plus acres and have adequate frontages. Mr. Gourley <br />noted the fee paid was fgr two new lots and an additional $50.00 would be required since <br />four new lots will be created. <br />Mr. Bohjanen moved to recommend the Council approve these variances subject to receipt of <br />the additional $50.00. Mr. Reinert seconded the motion. Motion declared passed. <br />Mar Don Homes <br />Mar Don Homes had sent a concept drawing of a proposed retail sales and office building <br />to the P & Z Board for their comments. They, plan to locate this proposed building on a <br />commercial lot on Lake Drive in the Caroles Estates 11 plat. <br />Mr. Gourley said he could not see any problem with the usage of this lot, however, it must <br />meet setbacks, parking requirements etc. as required by ordinance. He asked the Clerk to <br />inform Mar Don Homes of this. Mr. Hill suggested the Clerk ask Mar Don Homes to study <br />the parking facilities better. <br />Gene Mobley - Zoning <br />Mr. Mobley explained that the property he owns at 6910 - 22nd Avenue is zoned commercial <br />but limited to antiques sales and warehousing. He now plans to build a building to house <br />mostly recreational vehicles ( he will rent spaces for the storage of these vehicles). <br />It is strictly a cold storage building. <br />Mr. McLean suggested that Mr. Mobley rezone to a classification that would be broad enough <br />to cover any use he could anticipate in the future. He felt since this property is totally <br />surrounded by the Acton Company industrial park there should be no problem rezoning this <br />property. <br />Mr. Gourley suggested rezonig to General Business. Mr. McLean told Mr. Mobley to pick <br />up the material in the Clerks office and start the procedure. <br />Mr. Mobley asked if he could speak to the Board a.,minute on another subject, holding ponds. <br />Presently the Rice Creek Watershed District (RCWD) is requiring holding ponds on new plats. <br />He explained the problem that this is going to create in building up water eventually caus- <br />ing the water to flow back into basements and causing massive soil contamination. <br />Mr. Reinert explained that the RCWD is suppose to be a systems Board assisting Cities in their <br />over all plan for water flow. Mr. Mobley said this is absolutely not done. There is not <br />anyone on that Board that understands this problem and an overall system is not being dev- <br />eloped and he wanted the P & Z Board and Council to be aware that a problem is being created. <br />Mr. Reinert asked, in your dealing with the RCWD have they not looked at a total system? <br />Mr. Mobley said absolutely not. <br />Mr. McLean noted that the Clerk is presently trying to set up a meeting with the RCWD and <br />
