Page -2- November 16, 1977 <br />Mr. Baber (Huber Property) Variance <br />Mr. Baber representing Mr. Huber requested a variance for a long driveway on the property <br />line of lots 5 and 6 on Bald Eagle Boulevard.%,c This driveway does not go to a residence. <br />Mr. Baber presented the background beginningthe division of the land, the problems invol- <br />ved with removing dirt from accross the street to construct the private driveway and res- <br />titution for the dirt. He also explained his contact with the Corp of Army Engineers and <br />the Division of Game and Wild Life. After all this Mr. Mobley told him he would need a <br />variance for the driveway over 300' in length. <br />Mr. Baber explained that both lots are now sold and the owners are aware that this is st- <br />rictly a private driveway. The drivwway itself is approximately 16' wide and runs to the <br />Hugo City line approximately 150' from Bald Eagle Boulevard. <br />Mr. Shearen asked if a variance was necessary for a driveway that does not go to a resid- <br />ence or other buildings. Mr. McLean said he thought the ordinance was for any driveway over <br />300'. He suggested Attorney Locher's opinion would be necessary. <br />Mr. McLean told Mr. Baber that the Council has not taken final action on his request for <br />a variance dated October 25, 1976 requesting a division of a lot into two lots each with <br />less than 150' front footage. He further explained he will take this matter before the <br />Council November 28, 1977 for the final action. <br />Mr. Shearen moved to direct this application for a variance to Attorney Locher for his <br />opinion as to the need for the variance. Mr. Hill seconded the motion. Motion carried <br />unanimously. <br />Mr. Shearen moved to direct the Clerk to inform Mr. Baber if the Ordinance does not per- <br />tain to his application. Mr. Hill seconded the motion. Motion carried unanimously. <br />James Davis - Variance Long Driveway <br />Mr. Davis applied for a variance for a long driveway on a piece of property he is buying <br />on Ware Road. Mr. Gourley said he could see no problems with his request other than a <br />certificate of survey is needed and the actual owner of the land should apply for the <br />variance. <br />Mr. Reinert moved to recommend to the Council that this variance be granted subject to <br />ownership of the land and that a certificate of survey be provided. Mr. Shearen seconded <br />the motion. Motion carried unanimously. <br />Constance Grundhofer - Special Use Permit <br />Mrs. Grundhofer applied for a Special Use Permit to operate a beauty shop in her home. <br />Mr. Gourley asked if there were any questions about the application. There were none. <br />Mr. Reinert moved to recommend to the Council that this Special Use Permit be approved. <br />Mr. Shearen seconded the motion. Motion carried unanimously. <br />Rezoning - Feed Rite Controls, Inc., Thomas Dellich <br />Mr. Gourley stated that Feed Rite has not stated what zoning designation they would like. <br />He suggested light industry. Mr. Dellich said they waited to discuss this point. <br />Mr. Dellich gave the Board a brief background on Feed - Rite Controls. Feed Rite is a dis- <br />tributor of chemicals dealing primarily with municipal and industrial potable water and <br />sewage systems. They have outgrown all their present facilities and wish to expand. Mr. <br />
