4 <br /> <br />Easements <br /> <br />Standard drainage and utility easements at least 10 feet wide are provided along all lot lines. <br />Drainage and utility easements are being dedicated on the final plat over stormwater <br />management outlots. Conservation easements shall be dedicated over the wetland management <br />corridor. <br /> <br />A drainage and utility easement exists per the plat of Speiser Acres but is not required to be <br />vacated. <br /> <br />A Driveway and Access Easement in favor of 441 Birch Street is required for the portion of the <br />existing driveway that extends onto 453 Birch Street. <br /> <br />A 40 foot wide Drainage, Utility, Trail and Access Agreement in favor of the City is required <br />over 453 Birch Street. <br /> <br />Storm Water Management and Erosion and Sediment Control <br /> <br />Per the revised Site Design Narrative and Storm Water Calculation report dated September 7, <br />2016, the existing site is mostly undeveloped open field with minimal tree coverage. Soil <br />borings generally indicate sandy materials (fine-grained sand – SP; fine-grained sand with silt – <br />SP-SM) with some silty materials (silty fine sand – SM). The majority of the site drains east and <br />north to Rice Lake. The plans have been revised to construct two (2) NURP ponds and one (1) <br />infiltration basin to manage stormwater. <br /> <br />A Homeowner Association (HOA) will be established to maintain the landscaping and <br />stormwater management facilities related to the infiltration basin. The draft HOA Bylaws has <br />been revised to include all 35 property owners. <br /> <br />A Development Agreement-Grading Onl y was approved by the City Council on September 26, <br />2016 by Resolution No. 16-108 to allow the developer to commence grading work prior to final <br />plat approval as allowed by the City’s subdivision ordinance. The developer; however, did not <br />execute the Agreement. <br /> <br />Public Land Dedication and Fees <br /> <br />Cash in lieu of land dedication shall be required. <br /> <br />St. Clair Estates <br />35 lots x $2,500 = $87,500 <br /> <br />Tree Preservation <br /> <br />Per the Final Tree Inventory and Tree Removal Plan, there are 114 total trees being removed on <br />site (6 in the Non-ESA outside the Basic Use Area (BUA) and 33 in a Natural Resource
