COUNCIL MINUTES <br />June 11, 2018 <br />APPROVED <br />118 6A) Consider Resolution 18-69, Approving Grading and Trunk Utility Agreement, <br />119 Watermark - City Engineer Hankee reviewed the written staff report. She noted the specifics of the <br />120 agreement. <br />121 <br />122 Council Member Stoesz noted the hours of construction activity. He wonders if, because of the <br />123 location far from anything, the developer has expressed interest in extending working hours. Ms. <br />124 Hankee said the hours included in the agreement mirror those in city code. Community Development <br />125 Director Grochala added that staff is currently working on an amendment dealing with a variance <br />126 process for construction noise. <br />127 <br />128 Council Member Manthey moved to approve Resolution No. 18-69 as presented. Council Member <br />129 Maher seconded the motion. Motion carried on a voice vote. <br />130 <br />131 6B) Nature's Refuge — i. Consider First Reading of Ordinance No. 0548 Rezoning <br />132 Property from R4, Single Family Residential to PUD, Planned Unit Development; ii. Consider <br />133 Resolution No. 1840 Approving PUD Development Stage Plan/Preliminary Plat — City Planner <br />134 Larsen reviewed a PowerPoint presentation including information on: <br />135 - Aerial view of proposed development; <br />136 - Council's expressed concern about some of the PUD flexibility; staff spoke with <br />137 developer and they will work on lots to bring them to minimum standards; <br />138 - With that, staff would still like to review the proposal so as to hear any other concerns <br />139 or questions at this time; <br />140 - History on original Nature's Refuge development; <br />141 - Existing site conditions, includng acreage, tree cover, wetland complex, rare plant and <br />142 animal species, <br />143 - Ditch and easement present; <br />144 - Density implications (low end of spectrum); <br />145 - Original site plan compared to current revised site plan; <br />146 - Trail location; <br />147 - Preliminary Plat (noted that it will be amended as previously discussed); <br />148 - Tree preservation plan (including tree buffers); <br />149 - Traffic study and level of service (C); <br />150 - Wetland impact review; <br />151 - Findings of Fact are included in council resolution; <br />152 - PUD Flexibility Summary (and what will be omitted). <br />153 <br />154 Planner Larsen noted that the council could elect to approve the actions, with the changes outlined <br />155 understood, or to table the matter. <br />156 <br />157 Mayor Reinert thanked staff for the extra effort in responding to his concerns about a certain element of <br />158 the PUD proposed. He doesn't think that flexibility is a bad thing, however, he sees that the City's <br />159 ordinances are generally upheld and very few variances are allowed. He had concerns with the PUD <br />160 presented at the work session so he brought those forward. He'd like to have further discussion about <br />161 the City's R1 zoning designation; is it still correct for this City? He sees the development is nice and <br />C! <br />
