Public Hearing: Zoning Ordinance Text Amendment Regarding Performance <br />Standards for Commercial Stables <br /> <br />Katie Larsen, City Planner, presented the Zoning Ordinance Text Amendment <br />Regarding Performance Standards for Commercial Stables staff report. City staff <br />received a complaint that a property has too many horses than permitted based on the <br />zoning and acreage. The subject site has operated as a horse training and selling <br />facility for the past 20 years and is considered a commercial stable under the zoning <br />ordinance. The issue to be discussed is whether commercial stables should be allowed <br />more animal units than standard rural zoning district uses. There are 2 commercial <br />horse stables in Lino Lakes. <br /> <br />Staff addressed questions from the Board: <br /> Mr. Ruhland asked if there was a previous ordinance in place <br /> Ms. Larsen stated that going back to 1985, a CUP was required <br /> Ms. Larsen doesn’t believe that any current commercial stables within <br />the City have an approved CUP <br /> Mr. Ruhland asked about common ownership and a rental agreement with <br />possible leasing options <br /> Ms. Larsen stated the property has to be in their ownership <br /> Mr. Evenson asked for clarify on leasing/common ownership on properties <br /> Ms. Larsen stated that would be a conversation to be had with the City <br />Attorney <br /> Mr. Evenson suggested 5 acres for dog kennels <br /> Mr. Evenson suggested removing the second point of the definition as it <br />seems redundant <br /> Mr. Laden asked if staff is going to do a follow up with the known businesses <br /> Ms. Larsen stated that those that are currently legally operating will be <br />grandfathered in <br /> Mr. Laden asked about tracking CUP and how leasing is tied within <br /> Ms. Larsen stated that would be a conversation to be had with the City <br />Attorney <br /> Mr. Root asked how this issue came up and if this property would be obeying <br />under current ordinances <br /> Ms. Larsen stated that the property of conversation is currently on 8 <br />acres with roughly 15 horses, but have an adjacent property under <br />common ownership <br /> The amount of animal units would be too high under the current City <br />Ordinance of 1 Animal Unit per 2 acres, however if the adjacent <br />properties are under common ownership, the parcels acreage would be <br />combined, given the proposed ordinance <br /> Mr. Laden suggested striking “middle of property” and keep 100 feet within <br />the proposed ordinance amendment
