<br />{00149157 12} 11. <br />viii. Rear elevations shall, at a minimum, have a combination of 2 exterior <br />materials, or 1 exterior material and 2 styles. The 2 styles shall be of contrasting <br />or complimentary colors. <br />ix. Rear elevations shall include some vertical and horizontal trim or element to <br />break up the longer elevation planes. <br />x. Side elevations of Townhomes that will face 21st Avenue North shall include <br />brick, stone or similar engineered product. These side elevations shall also have <br />2 other exterior materials, or 1 other exterior material and 2 styles. The 2 styles <br />shall be of contrasting or complimentary colors. Per the First Addition Final <br />Plat, these are Block 6, Lots 1, 58, 59 and 63. Plans provided in Exhibit “G” <br />have been deemed acceptable to meet the intent of this requirement. <br />xi. Side elevations not exposed to public roadways shall require only one exterior <br />material. <br />h. Garages: All townhomes shall include, at a minimum, a double garage and shall <br />comply with the following: <br />i. Garages shall be a minimum of 379 square feet. <br />ii. Garages shall be a minimum of 18’ 3” in width. <br />iii. Decorative garage doors with windows are required on all units. <br /> <br />4.5 Assignment to Others <br /> <br />The Developer may not assign this Master Agreement without the prior written agreement <br />of the City; provided, however, the Developer may assign this Master Agreement to any affiliate, <br />subsidiary, parent or successor entity of Developer, or to Owner, without the City’s consent. City <br />consent shall not be unreasonably withheld, conditioned or delayed. Upon assignment to a third <br />party, the Developer’s obligations under this Master Agreement for the affected phase or phases <br />of the Development shall be terminated. <br /> <br />Article V Master Plan Public Improvements <br /> <br />5.1 Storm Water Outlet <br /> <br />The City shall construct a storm water outlet from the western boundary of the <br />Development to Peltier Lake, and shall complete the same on or before December 31, 2020. <br />The City shall take all necessary and available steps, including, if necessary, the <br />commencement of eminent domain proceedings, to acquire title to the properties necessary <br />to construct the outlet, and shall have prepared and approved plans for the project on or <br />before June 1, 2019. <br /> <br /> 5.2 20th Avenue N. (CSAH 54) Turn Lane Improvements <br /> <br />Turn lane improvements from 20th Avenue North (CSAH 54) into the Development shall <br />be constructed by Developer, pursuant to approved Plans and at Developer’s sole cost. The <br />turn lane completion date shall be determined by the City based on when the turn lane is <br />needed for access to the Development. Developer is responsible for acquiring permanent
