SECTION 5. PETITION FORMS <br />Petitions for any improvement in the street right-of-way shall be submitted to the <br />Village Council for its approval. Petitioners shall use the approved Village form <br />which has been prepared for that purpose, these forms can be obtained from the Village <br />Clerk or the Village Engineer free of charge. <br />SECTION 6. ENGINEER'S PRELIMINARY REPORT <br />Upon the receipt of a petition from any property owner or owners, the Council shall <br />secure from the Village Engineer, a report advising it in a preliminary way as to <br />whether the proposed improvement is feasible and as to whether it should best be made <br />as proposed or in connection with some other improvement as recommended. <br />SECTION 7. DEPOSIT BY PETITIONERS FROM PRELIMINARY EXPENSE <br />A copy of the Engineer's preliminary report and estimate shall be furnished by the <br />Village to the petitioners. The petitioners shall be required to deposit an amount <br />equal to ten per cent (10%) of such preliminary estimate with the Village Clerk. This <br />money will be used to defray the expenses incurred by the Village in the preparation <br />of plans, specifications, legal service and advertising or any other preliminary ex- <br />pense involved in preparing for the public hearing. Any balance in this fund shall <br />be returned to the petitioners in the event that the work is not ordered after the <br />hearing, or it shall be applied to the cost of the project when completed. <br />SECTION 8. PLANS, SPECIFICATIONS AND BIDS <br />After the petitioners have deposited an amount equal to the ten percent (10%) of the <br />Engineer's preliminary estimate of the cost of any project, the Council shall instruct <br />the engineer to prepare plans and specifications for the project. After these plans <br />and specifications have been submitted to the Council by the Engineer and approved <br />by said Council, the petitioners may proceed with grading and installation of drainage <br />structures in accordance with said plans and specifications and under the supervision <br />of the Engineer' The petititoners may request this work to be done by the Village, in <br />which case the Clerk shall instructed by the Council advertise for bids for the con- <br />struction of the project. This advertising when necessary, shall be for such length <br />of time as the Council may deem advisable. This procedure to be in accordance with the <br />provisions of Minnesota Statutes Section 429, as amended. <br />SECTION 9. PUBLIC HEARING <br />After bids have been received, but before any contract is let or any work is ordered <br />by day labor for any improvement, the Village shall hold a public hearing on the pro- <br />posed improvement following two (2) publications in the newspaper of a notice stating <br />the time and place of the hearing, the general nature of the improvement, the estimated <br />cost, the area proposed to be assessed, and that the Village Council proposes to pro- <br />ceed under the authority granted by Minnesota Statutes Section 429; as amended. <br />SECTION 10. BOND TO GUARANTEE CASH PAYMENT FOR WORK BY PETITIONERS <br />After the public hearing described in the preceding section had been held and before <br />the award of any contract or the ordering of any improvement work by the Council, the <br />petitioners shall furnish a surety bond in the amount equal to one and one-half times <br />the cost of such work as submitted by the low bidder or in the case of day labor, work <br />as estimated by the Village Engineer. The surety bond shall guarantee the payment of <br />such assessment for all of the work contemplated in cash immediately upon its completion. <br />
