<br /> THE VILLAGE OF LINO LAKES
<br /> 1N ORDINANCE REPEALING ORDINANCE NO. 15 OF THE VILLAGE OF LINO LAKES, ESTABLISHING
<br /> " OFFICE OF FIRE MARSHALL AND REGULATING THE STARTING OF GRASS FIRES, THE BURNING
<br /> ^1HE VER OF LAND, AND THE BURNING OF RUBBISH AND COWUSTIBLE MATERIALS, AND FIXING PEN-
<br /> 1LTIES FOR THE VIOLATION THEREOF. The Village Council of the Village of Lino Lakes
<br /> toes ordain:
<br /> SECTION 1. It shall be unlawful for any person, firm or corporation to burn
<br /> rubbish, trash, paper, or other combustible materials in the Village of Lind Lakes,
<br /> axcept between the hours of 5 o'clock P.M. and 9 o'cloc.,k P.Afl. on Mondays thru Friday
<br /> of each week and between the hours of 7 o'clock A.M. End 9 ii'clock P.M. on Saturdays,
<br /> Sundays, and holidays, without first procuring from the Fire Marshall of said Village
<br /> or his authorized deputy, a permit f!+r so doing. Combustible materials shall be
<br /> Burned during the authorized hours, only within a safely constructed burner or simi-
<br /> lar device which will confine the burning partin'les. N.,� such burner shall be placed
<br /> within 15 feet of any flammable material, buildi�. or structure.
<br /> SECTION 2. No ashes, smoldering coals, embus, greasy or oily substances, nor
<br /> other matter subject to spontaneous combustion shall be deposited within 10 feet of
<br /> any wooden or plastered wall, partition, fence, floor, 1/umber, hay, shavings, rabish
<br /> )r other combustible materials except in metallic or other non combustible receptacles.
<br /> ;ueh non combustible receptacles, unless resting on thel'ground outside the building,
<br /> ;hall be placed on non combustible stands, and in everylease shall be kept at least
<br /> feet away from any wall or partition.
<br /> SECTION 3. It shall be unlawful for any person, fi*/rm or corporatien to, start
<br /> any grass firing in the Village of Lino Lakes, or burniover any lot, piece er parcel
<br /> :)f land in said Village, or cause, permit or allow th same to be done, without first
<br /> procuring from the Fire Marshall of the said Village,7or his authorized deputy, a
<br /> permit for so doing.
<br /> SECTION 4. All burning permits shall fix the time when and state the conditions
<br /> Winder which said burning shall be done. Except as hireinbefore provided, it shall
<br /> oe unlawful fer any person, firm or corporation to het, maintain or kindle a fire
<br /> contrary to the conditions set forth in said permit; or at any time other than stated
<br /> in said permit.
<br /> SECTION 5. No parent shall permit, authorize,'or allow a minor child to perform
<br /> any act prohibited in Section 1, 2, or 3, hereof.
<br /> SECTION 6. The Village Council shall appoint. a Fire Marshall. The Five Marshall
<br /> shall be given the authority and the responsibility to enforce all the provisions
<br /> of this ordinance under the direction of the Village Council. Any person, or persons,
<br /> who shall interfere with the Fire Marshall and the execution of his duties shall
<br /> upon conviction thereof be subject ti► the penalties provided herein. The Fire Mar-
<br /> shall is hereby given the authority to call upon the Constables for assistance in
<br /> enforcing any of the provisions of this ordinance. The term of office for the
<br /> appointed Fire Marshall shall be indefinite and shall terminate at the pleasure of
<br /> the Village Council. The Fire Marshall se far as it may become necessary for the
<br /> performance of his duties, shall have the right to enter any buildings or structure
<br /> upon sbcwing his badge of office.
<br /> SECTION 7. Ordinance No. 15 of the Village of Lino Lakes entitled An Ordinance
<br /> Prohibiting the Starting of Grass Fires or the Burning Over if Lots, Pieces or
<br /> Parcels of Land in the Village of Lino Lakes, Fixing Penalties for the Violation
<br /> Thereof, -- be and the same hereby is repealed.
<br /> SECTION 8. Any violation of this Ordinance shall be punishable by a fine not
<br /> to exceed $100.00 or imprisonment for a period of not more than 30 days, or both
<br /> such fine and imprisonment.
<br /> SECTION 9. This Ordinance shall be effective upon its passage and publication.
