4.16 SETBACKS ALONG THOROUGHFARES <br /> Along streets designated as "thoroughfare" in the Adopted Comprehensive <br /> Plan, the minimum setback from the thoroughfare for all buildings shall <br /> be forty (40) feet from the planned right-of-way line. Where the right- <br /> of-way width has not been established on the Thoroughfare Plan a one <br /> hundred (100) foot minimum setback from the center line of all existing <br /> thoroughfares shall be required except in cases where the existing 1i <br /> right-of-way exceeds sixty (60) feet, in which case a setback of forty <br /> (40) feet shall be maintained from the right-of-way line. <br /> 4.17 HEIGHT <br /> The height of structures used for churches, schools, multiple and simi- <br /> lar uses may extend to 45 feet in residential districts with non-occupancy <br /> structures of greater height requiring a special use permit. The required <br /> setback from any residential lot shall be at least equal to the height, <br /> and the distance between any two detached principal buildings shall be <br /> no less than one-half (�) the sum of the heights of the two structures , <br /> except that any structure exceeding 45 feet in height shall require a <br /> special use permit in all districts. <br /> 4.18 FENCES AND WALLS <br /> Fences shall be permitted in all yards subject to the following: <br /> (A) Solid walls in excess of 42 inches in height shall be prohibited. <br /> (B) Fences in residential districts may be located in any yard to a <br /> height of three and one-half (3�) feet, except that a fence up to <br /> six (6) feet in height may be erected on the lot line from the <br /> nearest rear corner of the principal building. <br /> (C) Should the rear lot line of a lot be common with the side lot line <br /> of an abutting lot, that portion of the rear lot line equal to the <br /> required front yard of the abutting lot shall not be fenced to a <br /> height of more than three and one-half (311) feet. <br /> (D) Fences located within eight feet or more from the rear lot line <br /> may be up to eight (8) feet in height. <br /> (E) Fences in Business and Industrial Districts may be erected on the <br /> lot line to a height of six (6) -feet; to a height of eight (8)=.feet <br /> with a security arm for barbed wire subject to conditional use permit. <br /> (F) Fences shall be at least 30% open (space for the passage of air <br /> and/or light) . <br /> (G) Prior to issuance of a building permit for any boundary line fence, <br /> abutting property owners shall be notified. <br /> (H) That side of the fence considered to be the face (facing as applied <br /> to fence posts) shall face abutting property. <br /> -11- <br />
