days during which time a public body may act to secure the necessary land. <br /> 4.23 AREAS WITHOUT SANITARY SEWER <br /> In areas without public water and sanitary sewer, single and two-family <br /> homes shall have a minumum lot area of one (1) acre; smaller lots may <br /> be permitted by the Village Councilonly if it can be demonstrated by <br /> percolation tests or other means that said smaller lots will not result <br /> in ground water, soil, or other contamination which might endanger the <br /> public health; likewise, larger lots may be required on the basis of <br /> percolation or other tests. <br /> Non-residential land uses may be permitted in areas without sanitary <br /> sewer only if a special use permit is issued; said special use permit <br /> shall not be granted if the Village Councildetermines that a satisfac- <br /> tory waste disposal method and system is not available. <br /> 4.24 QUASI-PUBLIC STRUCTURES <br /> No quasi-public structure shall be located within the public right-of- <br /> way except by permit issued by the Village Council,such structure <br /> shall include but not be limited to trash containers, bicycle racks , <br /> benches, planting boxes, awnings, flag poles, light standards, stairs, <br /> stoops, light wells, loading wells, signs, and others. <br /> Section 5. ADMINISTRATION <br /> 5.01 AMENDMENTS <br /> In accordance with the provisions of Minnesota statutes, the Village <br /> Council may from time to time, adopt amendments. Amendments may be <br /> initiated to the text by Council, Planning Commission, property owner, <br /> or resident. All proposed amendments shall be referred to the <br /> Planning Commission prior to adoption. The Planning Commission or <br /> Council shall hold a public hearing on the proposed amendment. <br /> 5.02 REZONINGS <br /> The procedure forchanging zoning district boundaries (rezoning) shall <br /> be as follows: <br /> (A) The Planning Commission, the Village Counci3, or property owner may <br /> initiate a rezoning. Persons wishing to initiate a rezoning of <br /> property shall fill out a "Zoning Form". The zoning form shall be <br /> accompanied by a fee as required in Ordinance No. 52 to be used for <br /> the costs of processing the application. The zoning form shall be <br /> filed with the village clerk. <br /> (B) Property owners or occupants within 300 feet of the property in <br /> -13- <br />
