HomeMy WebLinkAbout1974-057A Council OrdinancesORDINANCE NO. 57A CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA AN ORDINANCE ESTABLISHING A COMMISSION ON PARKS, RECREATION AND ENVIRONMENT. The City Council of the City of Lino Lakes, Anoka County, Minnesota, ordains: Section 1. Establishment: The Lino Lakes Commission on Parks, Recreation and Environment is hereby established. Section 2. Purpose: The purpose of this Ordinance is to establish a Commission which will aid and be advisory to the City Council of the City of Lino Lakes in its efforts to encourage productive and enjoyable harmony between man and his environment; to promote efforts which will prevent or eliminate damage to the environment and stimulate the health and welfare of man; to enrich the understanding of the ecological systems and natural resources important to the City; and to improve and insure a lasting quality of life within the City of Lino Lakes. Section 3. Definitions: A. "City". As used in this Ordinance, "City" refers to the City of Lino Lakes, Anoka County, Minnesota. B. "Commission". As used in this Ordinance, "Commission" refers to the Lino Lakes Commission on Parks, Recreation and Environment. C. "Council" or "City Council". As used in this Ordinance, "Council" or "City Council" refers to the City Council of the City of Lino Lakes, Anoka County, Minnesota. Section 4. Short Title: The Commission created and estab- lished by this Ordinance may be referred to as the Lino Lakes Commission on Parks, Recreation and Environment. Section 5. Composition: The Commission shall consist of seven (7) members. Each member of the Commission shall be a resident of the City of Lino Lakes. Section 6. Appointment and Compensation of Members: The members of the Commission shall be appointed by a majority of the Council and shall serve without compensation. Section 7. Terms of Office: The members of the Commission shall be appointed for terms of three years. The Commission shall have seven members, four (4) of whose terms shall expire on the first day of the next even numbered year after their appointment and three (3) members whose terms shall expire on the first day of the next odd numbered year after their appointment, with each person to serve until replaced by another appointment. Section 8. Vacancies: Vacancies occurring on the Commission shall be filled for the unexpired term by an appointment by a majority of the Council. Section 9. Removal of Members: The Council, by a unanimous vote of all its members shall have the authority to remove any member of the Commission from office whenever, in its discretion, the best interests of the City shall be served thereby. Section 10. Officers: The officers of the Commission may include a Chairman, Vice Chairman and such other officers as the Commission may deem necessary. An election of officers by the mem- bers of the Commission from their membership shall be held at the first meeting after establishment of the Commission and thereafter at the first meeting of each year thereafter. Section 11. Duties of Officers: A. Chairman. It shall be the duty of the Chairman to preside over all meetings of the Commission. In his absence, the Vice Chairman may preside or a chairman pro tempore may be selected to preside. Section 12. Rules and Procedures: The Commission shall adopt a set of rules to govern its own meetings and proceedings. The rules may be amended from time to time, but only upon notice to all members that the said proposed amendment shall be acted upon at a specified meeting. A majority vote of the Commission shall be required for the approval of the proposed amendment. Section 13. Meetings: A. Regular Meetings. The Commission shall meet in regular session at least once a month at the City Hall and at a time selected by a majority of its members. B. Special Meetings. The Chairman or any three members of the Commission shall have the authority to call special meetings of the Commission. Written notice of a special meeting shall be given to all members at least 24 hours prior to the time of the meeting, unless the time and place of the special meeting is set at a regular or regular adjourned meeting. C. Open Meetings. All meetings of the Commission shall be open to the public. Section 14. Powers and Duties of the Commission: The Commission shall have advisory powers and shall be subordinate to the City Council. Any powers other than advisory powers shall be only as directed by the Council. The following advisory powers shall become the duty of the Commission: A. To Develop Plans for the physical development of all present and future City parks and provide recommended plans to the City Council. 1. Refer to the projected recreational and environ- mental needs of the City and its citizens. 2. Completed plans will include a topographical lay- out of the park and all facilities, plus develop- ment cost estimates, and a proposed development time schedule, to include an annual operating budget. B. To Develop Policies and Plans for a Long Range City Park Acquisition Program and Provide the Recommended Program to the City Council. 1. Refer to City Land Use Comprehensive land and park land dedication policy included in present City Ordinance or any Ordinance amending or replacing same. 2. Completed program will include probable needed park locations, sizes and facilities plus acquisition and development cost estimates, to include land- scaping and equipment felt necessary. 3. Completed program will include a policy statement supporting the long range plan. 4. To recommend desire in the long range plan to the Council. C. To Develop Policies Concerning Recreational use of City Park Facilities and Provide Recommended use Policies to the City Council. 1. Policies, when adopted by the City Council will be administered by the City Administration. D. To gather information concerning the conditions and trends in the quality of the environment, both current and prospective, with the purpose of determining whether or not such conditions and trends are interfering or are likely to interfere with the goals of the City as established by the purpose of this Ordinance, and report to the Council. E. To develop and recommend to the Council policies to foster and promote the improvement of environmental quality, and meet the conservation, social, economic, health, and other requirements and goals. F. To report not less than once each year to the Council on the state and condition of the environment in the City, and to report on the work of the Commission. G. To make and furnish such studies or reports thereon, and recommendations with respect to matters of policy and legislation as the Council may request. H. To examine and make recommendations on all park sites proposed to be dedicated to the City by those proposing to plat lands within the City and those who propose to give lands to the City for parks. I. To make recommendations on the care, maintenance and development of existing parks. J. To act as liaison between the Council and people or organizations which may wish to use, care for, have recommendations for the use of or donate personnel, monies or equipment for parks and recreation in the City. K. To work with the County on development of County park space within the City and County. L. To review engineering and site plans for City improve- ments that may in any way change the characteristics of any City park or proposed park land. Section 15. Ordinance No. 57, of Lino Lakes, passed by the Council on August 23, 1971, is hereby repealed, the same being replaced by the within Ordinance. Section 16. This Ordinance shall be in force and effect from and after its passage and publication according to law. Passed by the City Council this ATTEST: Edna L.
