Title Commitment <br />The City Attorney shall review and comment on the title commitment and final plat. <br />Stormwater Maintenance Agreement <br />The stormwater maintenance of this subdivision will be covered under the City's <br />Programmatic Maintenance Agreement. <br />FINDINGS OF FACT -FINAL PLAT <br />The Planning and Zoning Board shall consider the final plat and the Community <br />Development Department shall forward the Planning and Zoning Board <br />recommendations to the City Council. The following requirements shall be met before <br />consideration of the final plat by the Planning and Zoning Board: <br />1. The final plat shall substantially conform to the approved preliminary plat and <br />phasing plan. <br />The final plat substantially conforms with the preliminary plat. <br />2. For plats that consist solely of individual single family residential lots, final plat <br />applications for subsequent phases shall not be approved until building permits <br />have been issued for 40% of lots in the preceding phase. This division applies <br />only when the preceding phase consists of 40 or more lots; and <br />This is a two (2) lot single family residential subdivision and will be platted in one (1) <br />phase. <br />3. Conditions attached to approval of the preliminary plat shall be substantially <br />fulfilled or secured by the development agreement, as appropriate. <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with a Development Agreement. <br />RECOMMENDATION <br />Staff recommends approval of the final plat for Poehling Addition subject to the <br />following conditions: <br />1. A basin and side yard drainage way are required to minimize stormwater and <br />pollutants from entering the public water. <br />2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 <br />feet in width but no less than 10 feet in width shall be installed and maintained on <br />both Lot 1 and Lot 2, Poehling Addition. <br />12 <br />
