A group of landowners, acting through a corporation, where <br />each owner agrees in advance to be bound by the conditions and <br />regulations which will be effective within the district and to record <br />such covenants, easements, and other provisions with the County <br />Registrar of Deeds. <br />9. Enforcement. If no construction has begin in the PDO within <br />twelve (12) months from the approval of the PDO and recording of <br />documents, said approval shall lapse and be of no further effect. The <br />Planning and Zoning Board, upon showing of good cause by the <br />developer, may extend for period(s) of twelve (12) months, the time for <br />beginning construction. <br />D. Substantive Criteria for Review and Approval. <br />1. Densily. The average density of the PDO shall not be greater than <br />that which applies to the existing zone where the PDO is proposed as <br />established in this Ordinance. <br />• 2. Minimum Open Space. Ten (10) percent of total parcel area. <br />a. A minimum of thirty-five (35) percent of the total project area <br />shall be reserved as open space (green area). (Active recreational <br />areas may be used in meeting open space requirements.) <br />b. All Common Open Space. At the election of the City, all <br />common open space shall be provided for by one of the following: <br />1) Conveyed to the City or conveyed to a non-profit <br />corporation or entity established for the purpose of <br />benefiting the owners. <br />2) Guaranteed by a restrictive covenant describing the <br />open space and its maintenance and improvement, running <br />with the land for the benefit of residents of the planned <br />development or adjoining property owners and/or both. <br />3. Height, Setback, and Lot Coverage Regulations. All such <br />restrictions shall be waived in development of a PDO except along the <br />perimeter of the development as long as the project is in compliance with <br />iaverage density and open space provisions of this Ordinance.
