Johnson felt that since the Council had forwarded this matter <br /> to the Park Board, there should be a recommendation from this Board. <br /> Mr. Johnson felt this is what the Council needs before sending these <br /> residents to other agencies for their approvals . He felt the residents <br /> needed to know if the purchase of the land is possible before seeking <br /> the requirements of the St. Paul Water Department. <br /> Mr. Mastro, who lives adjacent to the Outlot, presented his objections <br /> to the proposed use of this outlot. He felt there are some problems <br /> that should be considered. There is 13 acres across the street that <br /> is being considered for development that would increase the number of <br /> owners , also the existing owners of lake shore property should have <br /> an opportunity to be a part of the ownership of that property. He also <br /> wondered if any one had considered how this would affect the adjoining <br /> property owners when there are a lot of persons using that outlot - <br /> there could be a lot of noise and distrubance. He also listed some of <br /> the requirements of the St. Paul Water Department as to insurance. <br /> Mr. Mastro pointed out there is a 2500 acre park just on the other side <br /> of the lake with a good beach and there is also a boat accesss . <br /> Mr. Mastro felt that a decision should be made on this one way or the <br /> other. Either the land should be sold or the City should issue a <br /> policy statement on this land. <br /> There was a question as to how the City would be able to service the <br /> drainage ditch if the property is fenced and has a locked gate —this <br /> would mean that City vehicles would need to cross private property to <br /> do the work. It was generally felt that provisions could be made to <br /> allow the City to have access for this purpose. <br /> Mr. Flannery suggested that perhaps the City could consider the leasing <br /> of this property to a Home Owner ' s Association on a year to year basis . <br /> He pointed out the problems that could result in selling to a few <br /> residents who would have control over who is allowed in the Association. <br /> If this land is leased, then the City has control over how the land <br /> is used and who is allowed to use the access . Mr. Flannery felt it <br /> is vital that the City maintain ownership of the land and if , there is <br /> to be usage of the land by private citizens , then it should be on a <br /> year to year lease basis . <br /> Mr. Flannery moved to recommend to the City Council the consideration <br /> of a proposal for the leasing of this parcel of land in accordance <br /> with a lease plan that would be adopted by a Citizen' s Association. <br /> This lease plan would state who would have access to the property, <br /> how the property would be maintained, how the property would be im- <br /> proved and the liability that would be attached to the property if it <br /> were so improved. It would also be the responsibile of the Citizen' s <br /> Association to obtain permission from the St. Paul Water Department <br /> to use the land as they propose. All expenses involved would be the <br /> responsibility of the Association. Mr. Flannery pointed out it would <br /> necessary for the Citizen interested to form a non-profit organization <br /> for this purpose. Seconded by Mrs . LaBlond. Motion carried unanimously. <br />
