PARK BOARD MINUTES
April 2, 1990
The boy scouts will be helping with the food.
REVIEW OF TREE REMOVAL AGREEMENT/MARTY ASLESON
Marty explained that this tree removal agreement will be
beneficial in protecting the resident from diseased trees on
their lots. It will be up to the developer to remove all
diseased trees, debark their stumps to below ground or remove
stumps to a depth of six inches below ground level .
The City Tree Inspector will paint a tree number on all
diseased trees and notify the contractor as to which ones the
contractor shall remove.
Upon removal of the trees , the contractor shall paint the
number painted on the removed tree on its debarked stump.
This tree removal agreement outlines dumping and burning of
trees, compensation to the contractor, permits and codes ,
responsibilities of the contractor, accident prevention,
safety, cleanup, and special provisions , advising the
resident , etc.
Bill Nissen had two suggestions :
1 . In the tree removal agreement it states that the resident
n has to be notified within 24 hours of when the developer
will remove the diseased tree. Bill Nissen suggested
that the adjacent property owners should also be
notified.
2 . In the tree removal agreement it states that the
contractor shall carry, during the life of this
agreement , property damage insurance with limits in an
amount of not less than $50 , 000 . 00 . . .
Bill Nissen feels that this amount should be higher.
The board discussed this issue. Marty stated that this is
the amount required for the general contractor to be licensed
in the city. Bill Nissen felt that the insurance should be
$1 , 000 , 000, 000. 00 for general liability insurance. Marty
also felt that if the insurance is inappropriately high a lot
of good quality people would not bid for tree removal jobs .
This will be sent to the city attorney for his comments .
MOTION: Bill Nissen moved to send this Tree Removal
Agreement to the city attorney for his review, and the
board' s recommended changes will be addressed by the
attorney. After the city attorney reviews this agreement, it
will go to the city council for review and approval . John
Bauman seconded the motion and the motion was approved
Page 4
