whether or not the same has been covered in whole or in part <br /> by payments made by the City. <br /> b . In an emergency affecting the safety of life or <br /> property, on or adjoining the site, the contractor shall act <br /> either at his own discretion or as instructed by the City to <br /> prevent such threatened loss or injury. Any compensation <br /> claimed by the Contractor on account of such emergency work <br /> will be determined by the City. <br /> C. The Contractor shall avoid damaging sidewalks, <br /> streets , curbs, pavements, utilities, structures, or any <br /> other property (except that which is to be replaced or <br /> removed) , either on or adjacent to the site. He shall repair <br /> at his own expense and in a manner satisfactory to the City <br /> any damage thereto caused by his operation. <br /> 16. Indemnification. The Contractor shall indemnify <br /> and save harmless the City from any claims for damages <br /> resulting from personal injury and/or death suffered or <br /> alleged to have been suffered by any person or corporation, <br /> public or private, and for any damage to or destruction of <br /> property, public or private, as a result of any work <br /> conducted under this Agreement . <br /> 17. Surety Bond. The Contractor shall , within ten (10) <br /> days of executing this Agreement, furnish a surety bond to <br /> the City in the sum of Five Thousand Dollars ($5, 000. 00) for <br /> the use of the City and of all persons doing work or <br /> furnishing skill, tools, machinery, materials, or insurance <br /> premiums under or for the purpose of this contract by the <br />
