It <br /> seems the final plat that was approved showing the trail system is <br /> different than the plat the builders were showing to potential <br /> buyers. When asked for his opinion, Mr. Asleson noted that he hates <br /> to see the trail go, but he most certainly can understand the <br /> frustration of the homeowners. From a comprehensive trail <br /> management standpoint, this trail link is definitely needed. <br /> A discussion followed where everyone agreed that the placement of <br /> a trail next to these houses in not desirable under the present <br /> circumstances, and it would be nice to find an alternative. There <br /> is a lot left near the end of the cul-de-sac that is not sold yet. <br /> There was a suggestion that this may be a good place to put the <br /> trail (down the middle of the lot) and buyers would know from the <br /> start that there would be a trail running next to their house. <br /> George Lindy feels that the burden should be on the builder to find <br /> an alternative. Ken Johnson thinks the developer has slighted both <br /> the builder and the home buyer and should come up with some type of <br /> resolve in providing a trail link. He also feels that Rick Carlson <br /> should be involved in settling this issue with both us and the <br /> homeowners. <br /> Bill Nissen would like to see both the builder and the developer <br /> present their sides to the board. He says he would like to help <br /> out, but also wants the trail. He asked if the City could get more <br /> involved in this. <br /> Mr. Appleby says he spoke with Mr. Carlson about the problem and <br /> Mr. Carlson seemed quite belligerent, and Mr. Kuny says that Mr. <br /> Carlson didn't return his phone calls. <br /> George Lindy thinks we need some legal advice. Ken Johnson <br /> suggested that Marty Asleson have the City Attorney contact Mr. <br /> Carlson about the situation. All were in agreement that it is the <br /> developer's obligation to provide access and alternatives, and they <br /> would prefer not to see a trail where it is now and would like to <br /> see an alternate route.
