Incorporation by Reference. All plans, special <br /> provisions, proposals, specifications and contracts for <br /> the improvements furnished and let pursuant to this <br /> agreement shall be and hereby are made a part of this <br /> agreement by reference as fully as if set out herein in <br /> full. <br /> XII . VIOLATIONS/BUILDING PERMITS. In the event that Developer <br /> violates any of the covenants and agreements contained in this <br /> Development Contract and to be performed by the Developer, the <br /> City, at its option, in addition to the rights and remedies as set <br /> out hereunder may refuse to issue building permits to any property <br /> within the plat until such time as such default has been corrected <br /> to the satisfaction of the City. <br /> XIII. PARK DEDICATION. The City hereby agrees that the park <br /> dedication shown within the subdivision shall satisfy all land <br /> dedication requirements except one acre to lie conveyed at the time <br /> of the third addition. When Outlot A of the subdivision is <br /> replatted as the second subdivision, Developer will perform grading <br /> work within the park areas shown on the first and second additions <br /> to make same suitable for passive uses according to the concept <br /> plan. Such grading costs shall not exceed Five Thousand and no/100 <br /> ($5, 000) Dollars. At the time that the third addition is <br /> developed, Developer will dedicate one additional acre within, or <br /> without, the plat or the cash equivalent, at the option of the <br /> REF DC03 <br /> 15 <br />
