City of Lino Lakes <br /> Park Board Meeting <br /> July 6, 1998 <br /> n <br /> Rick explained that his most significant concern deals with the <br /> liability issue. Rick referred to a letter of response from City <br /> Attorney, Bill Hawkins . Mr. Hawkins claims that it is possible <br /> to lease a portion of the park for this purpose. <br /> Rick stated that if the City accepted the offer to lease some <br /> land to Mrs . Scheele she would be obligated to obtain general <br /> liability insurance coverage and name the City as additional <br /> insured. Furthermore, the lease would require the entity to <br /> indemnify the City for any injuries that may take place on the <br /> property. The current tort limits are $300, 000 per claim and <br /> $750, 000 per occurrence. <br /> Rick stated that Quail Ridge Park was master planned this past <br /> winter. In prioritizing the overall park system needs, Rick <br /> indicated he did not anticipate development of Quail Ridge Park <br /> for quite some time, unless a significant amount of financial <br /> assets are secured (bond referendum) . <br /> Chair Lindy stated that according to the letter from the City <br /> Attorney, the City can lease park property to a citizen. <br /> Pat asked if the citizen then has right to that property. Rick <br /> stated that the City still owns the land. The citizen can use <br /> the land for a specific purpose. <br /> Sharon asked if only the group could use the land. Rick stated <br /> that those details would be worked out in the lease. <br /> Paul raised the issue of someone getting hurt that was not with <br /> the group. He asked if the group would be allowed to limit use <br /> of the property. <br /> Rick stated that a detailed lease has not been drawn up. Several <br /> issues would have to be worked out. <br /> Chair Lindy stated he would not want the property closed to <br /> passerby' s and bikers . Rick stated the lease would indicate a <br /> specific limited area. The area would not affect passerby' s . <br /> Pam asked if other cities have done this . Rick stated that he is <br /> not aware of other cities doing this. <br /> Paul indicated the need for a specific time frame regarding the <br /> lease. He stated that the kids worked very hard on the BMX <br /> track. <br /> ,^ Rick stated the question is if it is good public policy to lease <br /> park land.
