The City <br /> Attorney will have to have all these issue addressed to ensure <br /> the City is not liable. He applauded the children for their <br /> effort. <br /> Chair Lindy stated that the Park Board will agree to lease the <br /> property contingent upon the City Attorney' s opinion and <br /> contract. Residents will have to construct the track and provide <br /> proof of insurance. <br /> Pat asked if the City will review and inspect the track. <br /> Joe stated the City will not be involved with the BMX track. <br /> Paul suggested the lease be a short term lease because the park <br /> has been master planned. The business aspects of the lease will <br /> be negotiated to protect the City. <br /> Chair Lindy noted that stipulations from the insurance company <br /> may change the decision of the Park Board. <br /> Mr. Scheele added that the parents of the children that used the <br /> track did agree that they are responsible for injuries . Injuries <br /> have already occurred. <br /> Chair Lindy stated that the Board agrees to lease the land. The <br /> next step is to obtain insurance and provide it to the City <br /> Attorney. A contract will then be drawn up for a final <br /> presentation and review. <br /> Pam noted this is a great learning experience for the children. <br /> She stated that she hopes it works out for them. <br /> Rick suggested Mr. Scheele offer waivers from parent for <br /> permission to use the track to the insurance company. <br /> Mr. Scheele thanked the Board for their time. <br /> Sharon asked if the City will pay the City Attorney for any work <br /> done. Rick stated the City will deal with payment of the City <br /> Attorney. <br /> Sharon noted concern regarding residents in the area. <br /> Mr. Scheele stated that all neighbors in the area are involved. <br /> He also stated that a fund-raiser could pay the City Attorney. <br /> 6 <br />
