DECLARATION OF COVENANTS, CONDITIONS, <br />AND RESTRICTIONS <br />This Declaration, made this day of , 1991 by Hokanson Development, Inc. <br />(hereinafter referred to as the "Declarants"). <br />Witnesseth: <br />Whereas, the Declarants are the purchasers of the following described property located in the <br />City of Lino Lakes, Anoka County, State of Minnesota. <br />Whereas, the Declarants intend to develop the aforementioned area into single family lots and <br />townhome lots in accordance with the ordinances and zoning classifications applicable to this <br />area. <br />NOW THEREFORE, the Declarant hereby declare that the real property described as the <br />Wenzel Farms Plat, shall be owned, held, transferred, sold, conveyed and occupied subject to <br />the covenants, restrictions and liens hereinafter set forth, which covenants, restrictions and liens <br />shall run with the real property, and be binding on all parties having any rights, title or interest <br />in the Plat or any part thereof, and their heirs, successors, representatives and assigns. <br />ARTICLE 1 <br />The following words shall have the following meaning unless the context shall otherwise require: <br />1. LENDING INSTITUTION shall mean any person, partnership, corporation, or entity who <br />is a mortgagee, holder of a mortgage, or a contract vendor on a lot in the Plat, or a person, <br />partnership, corporation, or entity who is about to become a mortgagee, holder of a mortgage, <br />or a contract vendor upon the sale of any lot in the Plat. <br />2. LOT shall mean and refer to any lot contained in any block shown upon the recorded Plat. <br />3. OWNER shall mean the record owner, whether one or more persons or entities, of the fee <br />simple title to any lot contained in the Plat, and subject to this Declaration, but shall not mean <br />or refer to any lending institution unless and until such lending institution has acquired title <br />pursuant to foreclosure and the period in which the fee owner may redeem from such foreclosure <br />has terminated, or until such lending institution has acquired title by deed in lieu of foreclosure. <br />4. SALE shall mean any transfer, conveyance, or contract to convey any lot, whether for <br />consideration or not, and whether the transfer, conveyance or contract to convey is placed of <br />record in the Office of the Registrar of Titles or not. <br />SAMPLE DRAFT <br />1 <br />
