CITY OF LINO LAKES <br /> PARK BOARD MEETING <br /> MONDAY, DECEMBER 5, 1994 <br /> The Church is requesting the revisiting of this dedication for <br /> the trail (park dedication) along Reshenau Lake. As is stated in <br /> Pastor Kendrick' s letter, the overall cost for the trail as per <br /> dedication agreement exceeds the costs that the church would have <br /> paid on a straight cash dedication. The church is thus proposing <br /> to dedicate the land for this trail and the remainder in cash for <br /> construction purposes. <br /> Pastor Kendrick was present to discuss this issue with the Park <br /> Board. He said through the process of negotiation this request <br /> is what they had arrived at. They are asking for a <br /> reconsideration because of the cost factor in erecting the trail. <br /> George asked, from an ordinance standpoint, if there was protocol <br /> in handling a situation like this. Marty responded that the Park <br /> Board would have to make a new motion. Mary Kay Wyland said that <br /> the dedication is not recorded with the plat at the county. She <br /> also stated that it would have to go to the City Council. <br /> Amy asked about the setback from the lake, was it in wetlands. <br /> Marty stated that it was out of the wetlands. <br /> George mentioned budgeting this project, in the future, if it was <br /> decided to reconsider the dedication. <br /> There was also discussion about setting precedence by doing this, <br /> whether other groups or developers would want to do this, how <br /> this would affect the goals set for 1995, whether the city would <br /> have to put the trail in or if a contractor would be hired, and <br /> that the transportation trail is not an issue in this change. <br /> It was brought up that in October of 1992 Bob Kirmis suggested <br /> that the city should amend its park dedication ordinance to <br /> reference specific regulations imposed on public/semi-public <br /> uses. This has not been done so the Park Board may want to <br /> revisit this in the near future. <br /> MOTION: Brian Bourassa made a motion, seconded by Amy Donlin to <br /> revise the original motion to require the transportation trail <br /> along Birch Street, as shown on the site plan, constructed to the <br /> gravel base according to the City' s standards. And secondly, to <br /> require a land dedication, as shown on the site plan, for 15 ' <br /> wide easement (no grading required, just for the easement) and a <br /> cash dedication equal to $7,250.00. Motion passed unanimously. <br /> After further discussion it was agreed that the church would be <br /> responsible for legal and survey costs. <br /> 2 <br />
