Consider Resolution No. 20-20 Approving Preliminary <br />Plat and Opening Sub-District 3C & 3D of Utility Staging <br />Area 2A (2020-2025) <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff presented Nadeau Acres to the City Council at the March 2, 2020 and May 4, 2020 Work <br />Session. The following is an update since the May 4th Work Session: <br /> <br />Stormwater Outlet. Staff met with the adjacent property owners (Vickers) on Thursday, May <br />7, 2020 to review options for a stormwater outlet. The owners explained their concerns over <br />possible ditch erosion and ongoing maintenance concerns. As noted at the work session, if an <br />easement is obtained, the City will be responsible for ongoing maintenance of the <br />improvements including the outlet area. The owner informed staff of their preference for a <br />piped outlet with a dissipater still incorporated with the understanding that it is city maintained. <br />Staff is working with the developer’s engineer on a modified design. <br /> <br />Great River Energy (GRE) Easement. The power line easement, running north/south, is owned <br />by Great River Energy. The developer received approval from GRE on Tuesday, May 5, 2020 <br />for work within the easement based on the existing plans. They are following up with GRE on <br />a plan amendment to extend pipe across to ditch. Since the existing approvals include both <br />sanitary, water and storm sewer lines, within the easement, we are not expecting any issues <br />with the new extension. <br /> <br />Josephine Lane and Utility Extension. The Vickers have raised concerns regarding the impact <br />of street, sewer, and water extension to their property line (Josephine Lane). Staff’s <br />discussions with the County Assessor’s office have indicated that the development of the <br />Nadeau Property, not the proximity of sewer/water utility and street improvement to the <br />property line, will drive any potential increase in value. However, staff is evaluating with the <br />developers’ engineer an option to pull back the sanitary, water main and street improvements <br />closer to the intersection. However in doing so, there will be an added cost to development of <br />the Vickers property in the future. Staff would also note that if the street is pulled back, it
