The Planning and Zoning Board shall consider the final plat and the Community <br />Development Department shall forward the Planning and Zoning Board <br />recommendations to the City Council. The following requirements shall be met before <br />consideration of the final plat by the Planning and Zoning Board: <br />1. The final plat shall substantially conform to the approved preliminary plat and <br />phasing plan. <br />The final plat substantially conforms with the preliminary plat. <br />2. For plats that consist solely of individual single family residential lots, final plat <br />applications for subsequent phases shall not be approved until building permits <br />have been issued for 40% of lots in the preceding phase. This division applies <br />only when the preceding phase consists of 40 or more lots; and <br />Not applicable. The final plat is comprised of a mix of cottage homes, senior living <br />campus building and future commercial development. <br />3. Conditions attached to approval of the preliminary plat shall be substantially <br />fulfilled or secured by the development agreement, as appropriate. <br />The conditions of the PUD Development Stage Plan/Preliminary Plat have been <br />substantially fulfilled. Securities will be required with a Development Agreement. <br />RECOMMENDATION <br />Staff recommends approval of the PUD Final Plan/Final Plat for Lyngblomsten at Lino <br />Lakes Addition subject to the following conditions: <br />1. The developer shall maintain a 25 ft wetland buffer as depicted on Sheet C0.00, <br />Wetland Buffer Map. <br />a. The wetland buffer and upland habitat will consist of vegetated land, <br />consisting primarily of plant species native to this region, that is not <br />cultivated, cropped, pastured, mowed, fertilized, used as a site for <br />depositing snow removed from roads, driveways or parking lots, subject to <br />the placement of mulch or yard waste, or otherwise disturbed, except for <br />periodic cutting or burning that promotes the health of the wetland buffer <br />or upland habitat, actions to address disease or invasive species, or other <br />actions to maintain or improve wetland buffer or upland habitat quality, <br />each as approved in writing by City staff. <br />b. The wetland buffer shall be maintained in accordance with standard <br />vegetation management practices. <br />2. The developer is responsible for the installation, establishment and future <br />maintenance of all landscaping, vegetation, fences and signage consistent with the <br />approved PUD Final Plan. <br />35 <br />
