1 <br />1 <br />1 <br />DESIGN REVIEW BOARD <br />July 11, 1990 <br />approval of a variance to permit the creation of a 10,500 <br />square foot lot (Lot 13, Block 3 of D. Erickson's 2nd <br />Addition), Application #90 -39. The design review board <br />having found the request meets the six findings of fact <br />required by law. <br />EASEMENT <br />MOTION: Mr. King moved to recommend to the city council <br />vacation of an easement for drainage and utilities as <br />currently exists between Lots 12 and 13 of Block 3 of D. <br />Erickson's 2nd Addition and acceptance of a revised drainage <br />and utility easement as shown in the revised certificate of <br />survey. Mr. Bergeson seconded the motion and the motion was <br />approved unanimously. <br />MINOR SUBDIVISION, APPLICATION #90 -32 AND CONDITIONAL USE <br />PERMIT, APPLICATION #90 -33 FOR DIANE SCHILLING. <br />MOTION: John Bergeson moved to remove this item from the <br />table. Mr. King seconded the motion and the motion was <br />approved. <br />The Schilling's own a two - family dwelling within Wollen <br />Estates. The applicants have been renting the two <br />residences.. They now wish to subdivide the lot and sell each <br />of the residences to persons who will reside there. This <br />requires a "zero lot line" split. <br />Mr. Chase asked about covenants. The covenants would also <br />have to be approved. <br />MOTION: Mr. King moved to recommend to the city council <br />approval of the request from James and Diane Schilling to <br />subdivide Lot 2, Block 1 of Wollen's Estates, Application <br />#90 -32. Mr. Bergeson seconded the motion and the motion was <br />approved. <br />MOTION: John Bergeson moved to recommend to the city council <br />approval of the request from James and Diane Schilling for a <br />Conditional Use Permit allowing a zero lot line division and <br />use of residential property, Application #90 -33 on the <br />following conditions: <br />1. The declaration of covenants, conditions, <br />easements, and restrictions be recorded at the <br />Anoka County Court House. <br />Mr. King seconded the motion and the motion was approved <br />unanimously. <br />MOTION: Mr. King moved to recommend that the covenants be <br />subject to review and approval by the city planner and <br />building official.
