COUNCIL MINUTES <br />DRAFT <br />3 <br />tenders was reviewed as well as the requested action of authorizing a purchase and approval of an 80 <br />interfund loan. If the amount authorized changes, the council will be informed. 81 <br />Mayor Rafferty remarked that these are very important appartus in order for the City to provide fire 82 <br />services to residents. 83 <br />Councilmember Cavegn moved to approve the contract as recommended. Councilmember Lyden 84 <br />seconded the motion. Motion carried on a voice vote. 85 <br />Councilmember Cavegn moved to approve Resolution No. 22-103 as presented. Councilmember 86 <br />Lyden seconded the motion. Motion carried on a voice vote. 87 <br />PUBLIC SERVICES DEPARTMENT REPORT 88 <br />5A) Consider Resolution No. 22-101, Accepting Quotes and Awarding a Construction 89 <br />Contract, 2022 Trail Fog Seal Project – City Engineer Hankee reported that staff is prepared to 90 <br />receive quotes and award a contract for fog sealing services on the City’s trails. The cost for these 91 <br />services is budgeted and a bid has been received. She showed a map indicating the area that will be 92 <br />included. Councilmember Stoesz received confirmation that staff is comfortable with the only bid 93 <br />received (it is under the original project estimate). 94 <br />Councilmember Lyden moved to approve Resolution No. 22-101 as presented. Councilmember 95 <br />Stoesz seconded the motion. Motion carried on a voice vote. 96 <br />COMMUNITY DEVELOPMENT REPORT 97 <br />6A) Kwik Trip: i. Consider Resolution No. 22-94 Approving Conditional Use Permit for Motor 98 <br />Fuel Station; ii. Consider Resolution No. 22-95 Approving Conditional Use Permit for 99 <br />Commercial Car Wash; iii. Consider Resolution No. 22-96 Approving Site Improvement 100 <br />Performance Agreement – City Planner Larsen reviewed a presentation that included information on 101 <br />the following: 102 <br />- Land Use Application – conditional use permit and site and building plan review; 103 <br />- Site Location and Aerial Map; 104 <br />- Site Conditions – woods, wetlands, adjacent neighborhood; 105 <br />- Site Plan – building is being shifted from residential as much as possible; 106 <br />- Hour of Operation – less for car wash; 107 <br />- Trail – connects to City’s trail corridor; 108 <br />- Building Setbacks, Architectural (exterior), Fuel Canopies, Tree Preservation Plan, 109 <br />Landscaping, Wetland (including some conservation easements); 110 <br />- Staff and Board Comments – Public Safety, Environmental Board, Planning and Zoning Board 111 <br />(public hearing held – resident comments noted); 112 <br />- Findings of Fact – based on findings, the project should move forward; all requirements are 113 <br />being met; 114 <br />- Findings of Fact for Car Wash. 115 <br />Mayor Rafferty asked staff to review the City’s requirements under the statutory review period. Ms. 116 <br />Larsen noted that the first 60 day period has passed (September 9th) and staff has applied for the 117
