2. <br />ARTICLE 1. <br />PURPOSE AND GEOGRAPHIC AREA <br />1.1) Purpose. The Parties desire to cooperate in the joint environmental review and <br />joint long range planning of the Scannell Business Park within Lino Lakes and Columbus. <br />1.2) Geographic Area. All of the Scannell Business Park located in Lino Lakes and <br />Columbus as depicted on Exhibit A, which is attached hereto and made a part of this Agreement. <br />ARTICLE 2. <br />EFFECTIVE DATE, TERM, AND NOTICES <br />2.1) Effective Date. This Agreement will be effective from the date both Parties <br />execute the Agreement. <br />2.2) Term. This Agreement will remain in effect from the Effective Date until <br />terminated or until the AUAR is completed and published, whichever occurs earlier. This <br />Agreement may be terminated by mutual consent at any time and may be terminated by either <br />party on one hundred eighty (180) days’ written notice. <br />2.3) Notices. All notices relating to this Agreement will be in writing and provided to <br />each Party’s clerk or administrator. <br />ARTICLE 3. <br />RESPONSIBLE GOVERNMENTAL UNIT AND COOPERATION <br />3.1) Responsible Governmental Unit Authority. The Parties desire to jointly <br />participate in the environmental review of the Scannell Business Park. Consistent with <br />Minnesota Rules Chapter 4410, Section 441.0500, and one jurisdiction will act as the RGU for <br />the proposed AUAR. The Parties agree that one AUAR will be performed for the entire Property. <br />The parties further agree, subject to the terms and conditions of this Agreement, that Lino Lakes <br />will act as the RGU for the AUAR. <br />3.2) Joint Environmental Review. In consideration of the assignment of RGU <br />authority by Columbus to Lino Lakes for preparation the AUAR, the Parties agree to the <br />following: <br />(a) Lino Lakes will be responsible for the preparation, publication, and distribution of <br />the AUAR. <br />(b) Columbus will be copied on all communications between Lino Lakes and the <br />Developer and its agents and the Environmental Quality Board on all matters pertaining <br />to the AUAR.
